All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/ny/nyfiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Ronald Reid rreid21@cox.net December 18, 2012, 9:45 pm Marion, Wayne County Written: October 24, 1879 Recorded: October 28, 1879 New York, Land Records, Wayne County, Deed, Volume 127, page 165 This Indenture, made this twenty fourth day of October in the year of our Lord one thousand eight hundred and seventy nine between Levi Warner & his wife Ruth A. of the town of Palmyra in the County of Wayne & State of new York of the first part, and Friend Kenion (sic) of the town of Marion in the County & state aforesaid of the second part, Witnesseth, That the said party of the first part, in consideration of the sum of Five Hundred & three Dollars, to them duly paid, has sold, and by these Presents does grant and convey to the said party of the second part his heirs and assigns, all that tract or Parcel of Land, situate in the Town of Marion in the County of Wayne and State of New York bounded & described to wit Bounded on the north by lands of James Lown – on the East by land now owned by the estate of Samuel Springer deceased (being the Mill Pond lot) on the South by land of the said second party – on the west by the center of the highway leading from Marion Village to Palmyra – being sixty rods of land on which said second party now resides. With the Appurtenances, and all the Estate, Title and Interest therein of the said party of the first part. And the said Levi Warner does hereby covenant and agree to and with the said party of the second part his heirs and assigns, that the premises thus conveyed in the quiet and peaceable possession of the said party of the second part, his heirs and assigns, he will forever Warrant and Defend, against any person whomsoever lawfully claiming the same, or any part thereof. In Witness Whereof, The parties of the first part has hereunto set their hands and seals the day and year first above written. Sealed and Delivered in Presence of Joseph C. Rich State of New York On this twenty fourth day of Levi Warner seal Wayne County, ss: October in the year Ruth A. Warner seal One thousand eight hundred and seventy nine before me, the subscriber, personally appeared Levi Warner & his wife Ruth A. Warner to me known to be the same persons described in and who executed the within instrument, and severally acknowledged that they executed the same. And the said Ruth A. Warner on a private examination by me, apart from her said husband, acknowledged that she executed the same freely, and without any fear or compulsion of her said husband John C.
