Johnson, Palmyra, Wayne County, New York Proved 15 December 1826 In the name of God, Amen. I, Joseph S. Johnson of the Town of Palmyra, County of Wayne, and state of New York, being weak in body but of sound and perfect mind and memory blessed be Almighty God for the same, do make and publish this my last will and testament. In a manner and form following. First, I commit my soul into the hands of Almighty God who gave it and my body to the dust from whence it came, to be decently interred the expense of which to be paid by my executor out of my personal estate. Item. Respecting my worldly effects of which I am possessed at my dissolution my will is that they be disposed of as follows. To my well beloved wife Margaret I give and bequeath all my household furniture (excepting my cloak) to be at her disposal. Item. To my son Joseph and to his heirs and assigns forever I give and bequeath the farm on which I reside consisting of the West half of lot #89 North of the center line of township #11 in the townships in the county of Ontario and also about six as acres of land adjoining the above and of the Town of Palmyra, County of Wayne being the lot which I bought of James Galloway together with the appurtenances thereto belonging and also are my personal property except what is heretofore bequeathed to my wife on condition he shall pay all the honest and just debts owing by me at my decease and that shall become chargeable to my estate he is also to give my wife aforesaid a decent and comfortable support so long as she remains my widow and permit his sister Betsey to have a home at his house so long as she remains single. And lastly I hereby constitute and appoint my sons David and Joseph executors to this my last will and testament hereby revoking all former wills by me made. In witness whereof I have hereunto set my hand and seal this twenty seventh day of June one thousand eight hundred and twenty five. Signed, sealed, published and declared by the above named Joseph Johnson to be his last will and testament in the presence of us who have hereunto inscribed our names as witnesses in the presence of the testator. Johnson, Zenas Drake Wayne County SS: Be it remembered that on the fifteenth day of December in the year of our Lord one thousand eight hundred and twenty six personally appeared before me Graham H. Chapin Esquire, Surrogate of the county of Wayne. James N. Johnson, who being duly sworn did depose and say that he deponent saw Joseph S. Johnson late of the county of Wayne deceased sign and seal the written instrument there shown unto him of which the foregoing is a true copy, purporting to be the last will and testament of the said Joseph S. Johnson deceased bearing date the twenty seventh day of June in the year of our Lord one thousand eight hundred and twenty five. That at the time thereof the said Joseph S. Johnson was of a sound disposing mind and memory to the best of the knowledge and belief of him the said deponent and that he the said deponent and James N. Johnson and Zenas Drake subscribed their names as witnesses to the said will in the presence of each other and in the presence of the testator. Graham H. Chapin. The people of the state of New York by the Grace of God free and independent, to all to whom these presents shall cause or may concern send greetings. Know ye that at the town of Lyons in the County of Wayne on the fifteenth day of December in the year one thousand eight hundred and twenty six before Graham H. Chapin, Esquire, surrogate of our said county, the last will and testament of Joseph S. Johnson deceased, a copy whereof is hereunto annexed was proved and is now approved and allowed of by us; and the said deceased having whilst he lived and at the time of his death, goods, chattels or credits within the state by means whereof the proving and registering the said will and the granting administration of all and singular the said goods chattels and credits and also the auditing, allowing and final discharging the account thereof doth belong unto us the administrators of all and singular the goods, chattels and credits of the said deceased and any way concerning his will is granted unto Joseph Johnson and David Johnson executors in the said will named hereby requiring you well and faithfully to administer the same and to make and exhibit in true and perfect all and singular the goods, chattels and credits and after to render a just and true account thereof when thereunto required. In witness whereof, we have caused the seal of office of our said surrogate to be hereunto annexed. Witness Graham H.
