All rights reserved. http://www.usgwarchives.org/copyright.htm http://www.usgwarchives.org/ny/nyfiles.htm *********************************************************************** Source: Wayne co NY Will Book Vol. B page 233 Written: 7 Mar 1837 (Quaker date seventh of third month of 1837) Probated: 24 Jul 1837 I, John Rogers of Galen, County of Wayne, and State of New York do make and ordain this my last will and testament in manner and form following viz: First I give and bequeath to my beloved wife Annis Rogers, one third of my farm free and clear, also the use of the who of said farm until my son Joseph Rogers, arrives to the age of twenty one. Secondly, I give and bequeath the other two thirds of said farm to my son Joseph Rogers when he shall arrive at the age of twenty one. In case of his death before that time, I give and bequeath to my aforesaid wife at the time my son would have been of age had he lived, one half of said farm. The other half I give to my brother's and sisters to be equally divided among them in case my said wife should die before my said son should become of age, that is, one third to my wife's heirs, and two thirds to my said son Joseph Rogers directly after her death. Thirdly, I give and bequeath to my beloved wife all my house-hold furniture, except such articles as belonged to my first wife, all which I give and bequeath to my said son Joseph D. Rogers. I also ordain and appoint should any of the following property remain unsold at the time of my decease, viz, one span of horses, one cow, five hogs, together with all other farming utensils all of which the executors shall sell within two months after my decease, and apply the products to the payment of the debt on said farm should they be sold before the product to be applied to the same purpose. All other personal property I give and bequeath to my beloved wife Annis Rogers. The wheat now on the ground after the expenses of harvesting and threshing to be applied by the executors to the payment of said debt on the farm, should any surplus be left of said money, after paying for the farmit is to be applied to the improvement of the farm. Further I nominate constitute and appoint my beloved wife together with my esteemed friends, Isaac Rogers and Stephen Y. Watson, sole Executors of this my last will and testament. Signed sealed published and declared by the said testator John Rogers, as and for his will and testament in the presence of us who have subscribed our names witnesses thereto in the presence of the said testator. In witness whereof I set my hand and seal this seventh day of the third month eighteen hundred and thirty seven. William Collins Matthew Rogers Sr. Stephen Y. Watson State of New York Wayne County. Stephen Y. Watson of the town of Galen in the County of Wayne and State aforesaid being duly affirmed says, that John Rogers died a natural death at the town of Galen in said County some time in the month of April last past. That he was a resident of the said county at the time of his death. That the said John Rogers deceased, left a last will and testament bearing the date the seventh day of March one thousand eight hundred and thirty seven. That the affirmant is one of the executors named in said will. That the deceased left a widow, Annise Rogers, who resides in the town of Galen aforesaid. That the deceased left one son, Joseph D. Rogers, the only heir at law, and next of kin to the said Deceased, who also resides in the said town of Galen. That the said Joseph D. Rogers is a minor under twenty one years of age, to wit, of the age of twelve years, and has no general guardian. Stephen Y. Watson Subscribed and affirmed this 24th day of July 1837, before me.
