Tompkins & W to Solomon Ackerman This Indenture made the twelfth day of March one thousand eight hundred and forty nine 12 Mar 1849 Between Searing F. Tompkins of the town of Greenburgh in the County of Westchester and State of New York and Joanna his wife parties of the first part and Solomon Ackerman of the same place party of the second part Witnesseth That the said parties of the first part for and in consideration of the sum of One thousand five hundred and seventy five dollars lawful money of the United States to them in hand paid by the said party of the second part at or before the ensealing and delivery of these presents the receipt whereof is hereby acknowledged and the said part of the second part his being (unclear) and administrator for ever release and discharged from the same by these presents have granted bargained sold aliened recorded released conveyed and confirmed and by these presents do grant bargain sell alien revise release convey and confirm unto the said party of the second part and to his heirs and assigns for ever ALL that certain piece or parcel of land situate in the Town of Greenburgh in the County of Westchester being the same property that was conveyed unto the said parties of the first part by Thomas Angevine of the Town of Mount Pleasant in said County and Sarah his wife by Deed of Warranty dated the seventeenth day of April AD Page 212 1848 and which said Deed is recorded in the office of the County Clerk of the County of Westchester in Liber 127 of Deeds page 205 said premises being the same as that were conveyed to Said Angevine and wife by J. Henry Ferris Master in Chancery by deed dated May 26 1845. in said deed is Bounded and described as follows viz The first piece whereon the dwelling house and barn stand viz on the Southerly side of the road leading from Tarrytown to the Greenburgh Church and is Bounded Beginning at the south east corner thereof by the said Mill River Road adjoining land in the possession of Daniel Dutcher thence westerly by the land in possession of said Daniel Dutcher to the top of the ledge thence northerly then westerly by land in possession of said Daniel Dutcher to the land of the late Wm. Van Wartz thence northerly by the said Van Wartz land and to the aforesaid Tarrytown Road thence easterly and southerly by the said Tarrytown Road as it now runs to the Saw Mill River Road near the bridge, thence southerly by the Saw Mill River Road to the place of the beginning Containing 25 acres be the same more or less, Excepting and reserving thereon all that part of said land Bounded and described as follows viz all that part of said piece of land above described which ____ Easterly of the Saw Mill River and is bounded on the was by Saw Mill River Road on the north by the Road from White Plains to Tarry Town on the south by land late of 213 Daniel Dutcher and on the west by the middle of the Saw Mill River as it now runs Containing by estimation three acres of land be the same more or less The second piece lying on the northerly side of the aforesaid Tarry Town Road is Bounded as follows Beginning at the south west corner therefor by the said Road and land late of Joseph H. Hall thence by the land late of said Hall a north easterly course to Saw Mill River then southerly by Saw Mill River to the aforesaid Tarry Town Road and thence by said Road north westerly to the place of the beginning Containing five acres of land be the same more or less The third piece being wood lot on the hill is Bounded northerly by land of Elisha Purdy easterly by the land of the late William Van Wart deceased southerly by land late of Jonathan S. Odell and westerly by land of Joseph Taxter Containing ten acres of land be the same more or less Subject nevertheless to certain Indenture of Mortgage made and___ (unclear) by the said Searing F. Tompkins to Thomas Angevine of the Town of Mount Pleasant to secure the payment of twelve hundred dollars with the interest on the land and promises above described bearing the date the 7th day of April AD 1848 the amount of which mortgage the said Ackerman has regained out of the aforesaid consideration of this conveyance and he the said Ackerman is to pay off and discharge said mortgage with all interest accruing thereon from and after the 7th day of April 214 next and to indemnify the said Tompkins from the payment of the same or any part thereof. Together with all and singular the tenements, hereditaments and appurtenances thereunto belonging or in anywise appertaining and the reversion and reversions remainder and remainders rents issues and profits thereof And also the estate right title interest dower and right of dower property possession claim and demand whatsoever as well in law as in equity of the said parties of the first part and of in and to the same and every part and parcel thereof with the appurtenances To have and to hold the above granted bargained and described premises with the appurtenances unto the said party of the second part his heirs and assigns to his and their own proper benefit and behoof forever Subject however to the aforesaid reservation and the aforesaid mortgage And the said Searing F. Tompkins for himself and his heirs executors and administrators doth covenant grant and agree to and with the said part of the second part his heirs and assigns that said Searing F. Tompkins at the time of the sealing and delivery of these presents is lawfully seized in his own right of a good absolute and indefeasible estate of inheritance in fee simple of and in all and singular the above granted and described premises with the appurtenances and his good rightfully power and lawful authority to grant bargain sell or convey the same in manner afore 215 said And that the said party of the second part his heirs and assigns shall and may at all times hereafter peaceably and quietly have hold use occupy possess and enjoy the above granted premises and every part and parcel thereof with the appurtenances without any let suit trouble molestation eviction or disturbance by the said parties of the first part his heirs or assigns or any other person or persons lawfully claiming or to claim the same And that the same now are free clear discharged and unencumbered of and from all former and other grants titles charges estates judgments taxes assessments and encumbrances of what nature of kind so ever except as herein stated And also that the said parties of the first part and their heirs and all and every person or persons whom so ever lawfully or equitably deriving any estate right title or interest of in or to the herein before granted premises by from and under or interest for him or them shall and will at any time or times hereafter upon the reasonable request and at the proper costs and charges in the law of the said party of the second part his heirs and assigns make do and execute or cause to be made done and executed all and every such further and other lawful and reasonable acts conveyances and assurances in the law for the better and more effectual vesting and confirming the premises hereby granted or so intended to his in and to the said party of the second part his heir and 216 assigns forever as by the said party of the second part his heirs or assigns or his and their counsel learned in the law shall be reasonably advised or required And the said Searing F. Tompkins for himself and heirs the above described and hereby granted and released premises and every part and parcel thereof with the appurtenances unto the said party of the second part his hers and assigns against the said part of the first part and their heirs and against all and every person and persons whomsoever lawfully claiming or to claim the same shall and will Warrant and by these presents forever Defend In Witness Whereof the parties to theses presents have heteunto interchangeably set their hands and seals the day and year first above written Sealed and delivered Searing F. Tompkins and Joanna his wife known to me to be the individuals described in and who executed the forgoing conveyance and severally acknowledged that they executed the same And the said Joanna on private examination by and before me apart from her husband acknowledges that she executed the same freely and without any fear or compulsion of her said husband 217 S.
