Will of Richard Hutchins, North Castle, Westchester Co., NY In the name of God Amen I Richard Hutchins of North Castle in the County of Westchester and Province of New York being of sound mind and memory but weak in Body blessed be God & knowing the uncertainty of my Continuance do make this my last Will and Testament in manner and form following that is Imprimis I order after my Decease my moveable Estate to be sold and my funeral charges and other Debts to be paid and discharged and the overplus if any be to remain in use for the bringing up the Children, but out of my moveable Estate I give my beloved Wife a Bed and furniture a riding Horse and side Saddle Item I order my Real Estate Houses & lands to be for the use of my beloved Wife five years to bring up my Children upon and at the expiration of said Term of five years I order all my Real Estate Houses & Lands to be sold and disposed of in manner as followeth to my beloved Wife I give and bequeath Sixty Pounds to my Daughter Sarah thirty pounds to my Daughter Phebe thirty Pounds and the remainder to be divided amongst my three Sons Isaac Jacob & John in such manner as that Isaac have ten Pounds more then either Jacob or John and the money to be put out for them all till they come of age & I order that my Sons all of them as they become old enough to be put out to learn Trades or Mysteries & I Constitute James Hunter & Zepheniah Birdsall & my beloved Wife Executors of this my last Will and Testament. Richard Hutchings (L.S.) Signed Sealed and Delived by Richard Hutchings the Testator for his last Will and Testament this 10 day of October Anno Domini 1761 in presence of us who were at the signing Peter Huggeford, K. Kinnicutt, Caleb Huestis. Westchester County} S.S. Be it remembered that on the 11th day of February one thousand seven hundred and Sixty four Personally came and appeared before me Caleb Fowler Surrogate of the said County Caleb Huestis School master and did Solemnly sincerely and truely Declare and affirm that he did see richard Hutchings sign and Seal the within written Instrument purporting to be the Will of the said Richard Hutchings bearing date the tenth day of October one thousand seven hundred and Sixty one and heard him publish and Declare the same as and for his last Will and Testament that at the time thereof he the said Richard Hutchings was of sound disposing mind and memory to the best of the knowledge and belief of him the said Caleb Huestis and that his name Subscribed to the said Will is of his proper Handwriting which he Subscribed as a Witness to the said Will in the Testators presence and that he the said Caleb Huestis saw Hezakiah Kinnecutt and Peter Huggeford the other Witnesses to the said Will lSubscribe their names as Witnesses thereto in the Testators Presence. Caleb Fowler Surrogate Cadwallader Colden Esquire his majesty's Lieutenant Governor and Commander in Chief of the Province of New York and the Territorries depending thereon in America To all to whom these presents shall come or may concern Greeting Know ye that at Westchester County on the Eleventh day of February last before Caleb Fowler Esquire thereunto Delegated and appointed the last Will and Testament of Richard Hutchings Deceased (a copy whereof is hereunto annexed) was proved and is now approved and allowed of by me the said Deceased having whilst he lived and at the time of his Death goods Chattels and Credits within this Province by means whereof the proving and Registering the said Will and the granting Administration of all and singular the said Goods Chattels and Credits and also the Auditing allowing and final discharging the account thereof doth belong unto me and that administration of all and singular the goods Chattels and Credits of the said Deceased and any way concerning his Will is granted unto James Hunter Zephaniah Birdsell and Dinah Hutchings the Executors in the said Will named being first duely affirmed well and faithfully to Administer the same and to make and Exhibit a true and perfect Inventory of all and singular the said goods Chattels and Credits and also to render a Just and true account thereof when thereunto required In Testimony whereof I have caused the Prerogative Seal of the Province of New York to be hereunto affixed at the City of New York the Eleventh day of May one thousand seven hundred and Sixty four.
