This tenth day of December in the year of our Lord one thousand seven hundred and Sixty two. I Dirck Storm of the Manner of Philips Burgh in the County of Westchester and in the Province of New York being weak in body but sound in mind and memory. Thanks be given to God for the same calling to mind the mortality of my Body and knowing that it is appointed for all men once to Dye do make and ordain this my last Will and Testament. That is to say first of all I give and Recommend my Soul into the hands of God that gave it and for my Body I recommend it to the Earth to be decently buried in a Christian like and decent manner at the discretion of my Executors. Nothing doubting but at the general Resurrection I shall receive the same again by the mighty Power of God and as touching such World Estate where with it hath pleased God to bless me in this Life I give, devise and dispose of the same in manner and form as follows: Item it is my Will and I do order that in the first place all my Just debts and funeral charges be paid and satisfied. Item it is my Will and I dorder that after my Decease that my well beloved Wife Elizabeth Storm shall remain and stay in the full Prosessions of my Improvement with all my moveables during ? Widow and have the benefit thereof. Item - it is my Will and I do order if she should marry again that then my Improvements do be sold and my moveable Estate for the benefit of my Wife and Children and my Wife to draw a full third out of the whole Estate and the two thirds to equally divided amongst my Children. Item it is my Will and I do order that after my Wifes Decease without any other marriage my Improvements to be sold with the Remainder of my moveable Estate and they do be divided amongst all my Children of their heirs likewise. I make constitute and ordain my well beloved Wife Elizabeth Storm my Executrix and my well beloved friend Hezekiah Seman my Executor. And I do hereby utterly disallow revoke and disannull all other former Testaments Wills Legacies and Executors by me in any ways appertaining before this time named, Willed and bequeathed; Ratifying and confirming this and no other to be my last Will and Testament. In Witness whereof I have here unto set my hand and Seal the day and year above written, Signed published and delivered by the said Dirck Storm to be his last Will and Testatment. Dirck Storm his X mark In the presence of us Samuel Dean, Hendrick Van Tessel, William Davids Westchester County Be it remembered that on the third day of November 1763 Personally came and appeared before me, Caleb Fowler Surrogate of the said County, William Davis of said County, Farmer. And being duely Sworn on his Oath declared that he did see Dirck Storm Sign and Seal the within written Instrument purporting to be the Will of the said Dirck Storm bearing date the tenth day of December 1762. And heard him publish and declare the same as for his last Will and Testament that at the time thereof he said Dirck Storm was of sound disposing mind and memory to the best of the knowledge and belief of him the Deponent. And that his name Subscribed as Witness to the said Will is of his proper hand writing which he Subscribed as Witness to the said Will in the Testators presence. And that he the Deponent said Samuel Dean and Hendrick Ventessel the other Witnesses to the said Will Subscribe their names as Witnesses hereto in the Testators Presence. Caleb Fowler Surrogate Lieutenant Governor and Commander in Chief of the Province of New York and the territories depending thereon in America. To all to whom these Presents shall come or may concern, Greeting. Know ye that at Westchester County on the third day of November last, before Caleb Fowler Esquire, thereunto Delegated and appointed the last Will and Testament of Dirck Storm Deceased. A copy whereof is hereunto annexed was proved and is now approved and allowed of by me. The said Deceased having whilst he lived and at the time of his Death, goods, Chattels and Credits within this Province by means whereof the proving and Registering the said Will and the granting Administration of all and singular the said goods, Chattels and Credits and also the Auditing allowing and final discharging the account thereof doth belong unto me. And that Administration of all and singular the goods, Chattels and Credits of the said Deceased and any way concerning his Will is granted unto Elizabeth Storm and Hezekiah Seaman the Executors in the said Will named being first duely Sworn well and faithfully to Administer the same and to make and Exhibit a true and perfect Inventory of all and singular the said goods, Chattels and Credits and also to render a Just and true account thereof when thereunto required. In Testamony whereof I have caused the Prerogative Seal of the Province of New York to be hereunto affixed at the City of new York the ninth day of December One thousand seven hundred and sixty three.
