They are underlined below. page 159 Widdow shall die shall die written twice. to to written twice joyn Eliah 28 April 1773 Elijah Tompkins son of Thomas Tompkins of Phillipsburgh in the County of Westchester and Province of New York to make this my last will and testament to dispose of my worldly estate which I hereby do in the following manner (viz) First I order all my just debts and funeral charges and the charges from this my last will to be paid out of my moveable estate in some convenient time after my decease by my Executor hereafter named. 2nd I give and bequeath to my beloved wife Susannah Tompkins all my household goods be the same more or less and one of my best horses and the side saddle all to be her own forever to dispose of as she thinks best. 3rd I give unto my said wife the use of all my farm and buildings where I now live and all the remaining removables so long as she remains my widdow 4th my will is that when my widdow shall marry or die which of them shall first happen that then all my estate shall be sold except three ewes and three lambs and the money arising from the sale be put to interest for my children and paid to them as they come of age in manner as follows to each of my sons twice as much as to my daughter and if either of my children shall die shall die before they come of age that then the share or shares so left shall be divided between the survivors in proportion. As I have above order their legacies to be paid to them and the three ewes and three lambs above excepted I order to be given to my son Thomas when he comes of age Lastly I hereby appoint my well beloved wife Susannah Tompkins and my brother nathaniel Tompkins to by my Executors of this my will confirming this and no other to be my las will and testament made this twenty eight day of April in the year of our Lord one thousand seven hundred and seventy three [ 28 April 1773] after the above Executors were names the Testator thinking it might be more safe to add another Executors appointed Noah Bishop to to joyn the before named Executor with as full power as if he hd been put in the same line with them and orders that the said Noah Bishop be noticed accordingly in Witness of the whole he has hereunto set his hand and seal the before written Eliah Tompkins {SS signed } Signed sealed and declared to be the last will of the above named Elijah Tompkins in the presences of us Thomas Tompkins x his mark Susannah Tompkins and Benedict Carpenter Westchester County ss Be it Remembered that on this twenty seventh day of August in the year of our Lord one thousand seven hundred eighty four [27 August 1784] personally cane and appeared before me Richard Hatfield Esquire Surrogate of the said county, Thomas Tompkins of Phillps Manor in the County of Westchester yeoman and he being duty sworn on his oath declared that he did see Elijah Tompkins deceased sin and seal the preceding written instrument purporting to be the will of the said Elijah Tompkins bearing date the twenty eighth of April in the year of our Lord one thousand seven hundred seventy three [ 28 April 1773] and heard him publish and declare the same as and for his last will and testament that at the time thereof he the said Elijah Tompkins was of sound disposing mind and memory to the best of the knowledge and and belief of him the deponent that his mark affixed to his name at the foot of the said will is of his own proper mark which he affixed his name as a witness to the said will in the presence of the testator and that the deponent also saw Susannah Tompkins and Benedict Carpenter the other witnesses to the same will subscribed their names as witnesses thereto in the Testators presence Richard Hatfield Surrogate the People of the state of New York by the Grace of God Free and Independent To all to whom these present shall come or may concern Send Greeting Know Ye that at Westchester County on the twenty seventh day of August in instant [ 27 Aug. ] before Richard Hatfield Esquire thereunto by us delegate and appointed the last will and testament of Elijah Tompkins deceased ( a copy whereof is hereunto annexed) was proved and is no approved and all allowed of by us and the said deceased having whilst he lived and at the time of his death goods chattels or credits within this state by means whereof the proving and registering the said will and the granting administration of all and singular the said goods chattels and credits and also the auditing all owing and final discharging the account there of doth belong unto us the Administration of all and singular the goods chattels and credits of the said deceased and anyway concerning his will is granted unto Susannah Downing late Susannah Tompkins and Executrix in the said will named she being first duly sworn well and faithfully to Administer the same and to make and exhibit a true and perfect inventory of all and singular the said goods chattels and credits and also to render a just and true account thereof when thereunto required In Testimony whereof we have caused the seal of our Court of Probates to be hereunto affixed Witness Thomas Tredwell Esquire Judge of our said Count at the City of New York the thirtieth day of August in the year of our Lord one thousand seven hundred and eighty four [ 30 Aug. 1784] David Judson Clk
