Sturdevant transcribed Oct/Nov. 2005 In the name of God, amen; I Samuel Sturdevant of the Town of Covington in the County of Genesee & State of New York, considering the uncertainty of this mortal life, and being of sound mind and memory, I do make and publish this my last will and Testament in manner and form, following; First I resign my soul into the hands of Almighty God, hoping and believing in the remissions(?) of my sins by the merits and mediation of Jesus Christ; My body I commit to the Earth to be buried at the discretion of my executors hereinafter named, and my worldly Estate I give and devise as follows; I give and bequeath unto my beloved wife Phebe Sturdevant one third of all the Estate real and personal of which I may be seized or possessed at the time of my decease, and which is intended to be in full satisfaction, and ? pessor of all Dower & thirds which she might legally claim out of my estate. To my daughter Clarissa Sturdevant, Mary Sturdevant, and Charlotte Sturdevant; now Clarissa Hambling, Mary Whipple & Charlotte Stoddard, I give & bequeath the sum of two hundred dollars severally to each, to be faithfully paid to them by my executors hereinafter names, as soon as may be after my decease. To my grandDaughters Clarissa Deveraux, and Phebe T(?) Deveraux, the children of my daughter Phebe Deveraux, deceased, I give and bequeath the sum of one hundred dollars respectively to each, to be paid by my said executors, as is herein before stated. In case of the death of any of my said daughters or granddaughters before this going into effect of this Testament then the amount above ? to them respectively is to be paid, by my said executors to their personal descendents. The residue of all my estate; real & personal of which I may be seized & possessed at the time of my death, I give and devise(.?.) my two sons, Alfred Sturdevant & Silas B. Sturdevant to be equally possessed. Enjoyed and divided between them, and I do hereby constitute & appoint the said Alfred & Silas B. the executors of this my last will & testament. Smith of ?, Genesee County State of New York Wyoming County } Be it remembered that at a Surrogate Court held at Perry in and for the County of Wyoming before William Mitchell, surrogate of said county on the 7th day February one thousand eight hundred and forty six, the last will and testament of Samuel Sturdevant, late of the twon of Covington, in the Countyy of Wyoming, deceased, of which the proceeding record of a will is a true copy, was admitted to be proved and recorded as a will of real and personal estate; after citations to the heirs and next of kin of the said deceased had been issued, served, returned, and filed according to law requiring them to appear before the said Surrogate to attend the proof of the said will, with ? proof of the service thereof in ? form of law; the said will was produced in the said Surrogate Court, and before the said Surrogate and the following depositions of the witnesses were therefore taken to establish the genuineness and validity of the said will for the purpose of having the ? proved and recorded as a will of real and personal estate. William Mitchell Surrogate County of Wyoming,| Surrogate Court. | In the matter of proving the will of Samuel Sturdevant, deceased.} County of Wyoming Ss Alfred T Bartow of the town of ? in the County of Genesee, being duly sworn, doth depose and say that he is a ?scribing witness to the last will and testament of Samuel Sturdevant, late of the town of Covington in the County of Wyoming, aforesaid, deceased. And this ? further sayeth that the said Samuel Sturdevant the said Testator, did in the presence of the this ?, subscribe his name at the end of this instrument which is now shown and exhibited to this ?, and which purports to be the last will and testament of the said Samuel Sturdevant, and which bears date on the 21st day of January in the year of our Lord, one thousand eight hundred and thirty six. And this ? further saith, that the said testator, did, at the said time of suscribing his name as aforesaid, at the end of the will, declared said? M. Smith , did thereupon suscribe their names at end of said will, as attesting witnesses merits in the presence and at the request of the said Testator. And this ? further saith that at the said time, when the said Testator subscribed his name to the said last will as aforesaid, and at the time of this ?'s subscribing his name as an attesting witness thereto, as aforesaid, the said testator was of sound mind and memory, of full age to execute a will, and was not under any restraint. Smith of the town of ? in the County of Genessee, being duly sworn, doth depose and say that he is a subscribing witness to the last will and testament of Samuel Sturdevant, late of the town of Covington in the County of Wyoming, aforesaid, deceased. And this ? further saith, that the said Samuel Sturdevant the said testator, did in the presence of this ?, subscribe his name at the end of this instrument, which is now shown and exhibited to this ?, and which purports be the last will and testament of the said Samuel Sturdevant, and which bears date on the 21st day of January in the year of our Lord, one thousand eight hundred and thirty six. Sturdevant of the town of Covington in the County of Wyoming aforesaid being duly sworn, doth depose and say that on or about the 8th day of december in the year of Our Lord one thousand and eight and forty five; the said last will and Testament was delivered to this ? for safe keeping by Phebe Sturdevant, and that the instrument now produced and offer ed for probate, is the same instrument which was so delivered as aforesaid to this ?; and further, this ? saith, that the said instrument was safely and securely kept by this ? in his possession from that time until on the said 8th day of December in the year of Our Lord one thousand eight hundred and forty five, when the said instrument was delivered by this ? to Wiliam Mitchell Surrogate of the said County for probates.
