In the name of God, amen.

I, James McCormick of the town of Java Wyoming County New York of the age of
seventy-nine years being of sound mind and memory, and considering the
uncertainty of this frail and transitory life, do therefore make, ordain,
publish and declare this to be my last will and testament, that is to say:

First - After all my lawful debts are paid and discharged, I give and bequeath
to my wife Catherine McCormick the use of my Real Estate until it is sold, and
the use of the proceeds of the sale for and during her natural life to be
accepted and received by her in lieu of dower also all of my personal estate
of whatever kind of nature excepting the proceeds of the Sale of the Real
Estate forever.

2 - I give and bequeath after the death of my wife Catherine McCormick to my
daughter Mary McCormick the sum of Eight Hundred dollars out of the sale of my
Real Estate forever.

3 - I give and bequeath the balance if any out of said sale to my son Charles
McCormick, and Catherine Kerwin and Delia Maloy my married daughters, and my
Grand Son Michael McCormick to share and share alike forever payable within
one year after the death of my wife Catherine McCormick.

4 - I give and devise all of my Real Estate situated in the town of Java
Wyoming County NY consisting of one hundred acres of land more or less to
Lucius F. Horton the executor and my wife Catherine McCormick the executor of
this my last will and testament hereinafter nominated and apointed in trust
for the paymentof my just debts and the legacies specified in the within with
power to sell and dispose of the same at public or private sale at such time
or times and on such terms and in such a manner as they shall see fit to do.
And I direct my executors to pay a Mortgate executed by me out of the proceeds
of the sale of my Real Estate.
Likewise, I make constitute and appoint Lucius F. Horton to be executor and
Catherine McCormick executor of this my last Will and Testament hereby
revoking all former wills made by me.

In Witness Whereof, I have hereunto subscribed my name and affixed my seal the
seventh day of February in the year of our Lord one thousand eight-hundred and
seventy-seven.
