All rights reserved. http://www.usgwarchives.org/copyright.htm http://www.usgwarchives.org/ny/nyfiles.htm *********************************************************************** Source: Wyoming co NY Will book Vol. 12 page 549 Written: 5 April 1880 Probated: 14 May 1883 Surrogate application 19 Mar 1883 Surrogate court date 14 May 1883 James Cromwell 2nd, Executor I, Michael Maloy, of the Town of Wethersfield, County of Wyoming, State of New York, being of sound mind and memory, do make, ordain, publish and declare this to be my last will and testament, that is to say: First, After all my lawful debts are paid and discharged, I give, devise and bequeath to my wife, Eliza Maloy, the use of all real and personal estate goods and chattels of what nature or kind soever during the term of her natural life. 2nd, I give and devise to Mary Eagan, my daughter and wife of John Eagan, deceased, the sum of one hundred dollars (or the two notes I hold against her of fifty dollars each.) 3rd, I give and devise unto my daughter, Eliza Ham, wife of Richard Ham, the sum of fifty dollars. 4th, I give and devise to my daughter, Rose Gleede, wife of Ambrose Gleede, the sum of one thousand & one hundred dollars. 5th, I give and devise to my daughter, Ann Mannion, wife of Michael Mannion, the sum of one hundred dollars. 6th, I give to my son, Patrick Maloy, my farm or all that tract or parcels of land situated in the town of Java, county of Wyoming, state of New York and bounded as follows viz: on the north by the highway, on the east by land occupied by James Halligan; on the west by land occupied by George Cuthburson & containing fifty acres to be used and enjoyed by him during the term of his natural life and immediately after his decease I give and devise the same to his children, Mary Maloy, Michael Maloy, Fanny Maloy, James D. Maloy, to be divided between them equally, share and share alike. 7th, I give and devise to my daughter, Catherine Campion, wife of James Campion, one thousand dollars. 8th, I give and devise to my daughter, Margaret Cromwell, wife of James Cromwell, ten dollars. 9th, I give and devise to my granddaughter, Mary Campion, daughter of James and Catherine Campion, one thousand dollars. 10th, I give and devise to Mary O'Connor, wife of Joseph O'Connor, the sum of one hundred dollars, that is the note I hold against them of that amount. And lastly, the property above devised and bequeath shall remain for one year after the decease my wife, Eliza Maloy, or if I should outlive her, one year after my decease as it is and the interest with the avails of the same to be put out for our burial services, tombstones for us and pay the priest for saying masses for us. And after the above legacies are paid as above devised and bequeath if there is anything left I devise and give to Ellen Hackett, wife of Mr. Hackett, the sum of one hundred dollars and the remainder to be equally divided between any heirs. Likewise, I make, constitute and appoint James Cromwell 2nd to be executor of this my last will and testament, hereby revoking all former wills by me made.
