SHEPHERD, the executor named in the Last Will and Testament of Lydia FRENCH late of the town of China in the County of Wyoming, deceased appeared in open Court before the Surrogate of the County of Wyoming and made application to have the said Last Will and Testament, which relates to both Real and Personal Estate, proved, and in each application the said Surrogate did ascertain by satisfactory evidence, who were the heirs of the said testator and their respective residences. In the name of God Amen, I LYDIA FRENCH, of Arcade, Wyoming County , New York, aged 52 years and upwards being of sound mind and memory and considering the uncertainty of this frail and transitory life, do therefore make publish ordain and declare this to be my last will and testament that is to say: First, After all my lawful debts are paid and discharged I give and bequeath to my husband, IRA FRENCH all the real and personal estate and xxx of which I may died signed in my own right, and all my interest in any such, in any other xxx of any name whatever, but should said IRA die without children, then all such xxx or the avails thereof that may remain at his decease, I direct to be equally divided amongst such children of my brother CHARLES BARNES as may then be living, and I devise a suitable burial as I have verbally directed my executor and the expenses thereof to be paid out of the Property I leave. And I hereby empower my executor to convey by deed any real estate I may xx xxx of, so as to carry out the above devise and bequest, as in his judgment may seem best Likewise I make constitute and appoint my friend C. O. SHEPHERD of Arcade to be executor of this my last will and testament hereby revoking all former wills by me made.
