WASHBURN, over the age of 21, resident of the Town of Attica, Wyoming County, State of New York wrote his will. He named his brother Junior T. WASHBURN, executor. He left his nephews Jerome B and Jerri(?) T WASHBURN $125.00 each. The nephews were under 21 at the time the will was signed. The will was witnessed by Carni (?) LINDSLEY and Whitney SCOVILLE, both of Attica. January 22, 1861 Junior T. WASHBURN presented the will for probate. February 4, 1861 The will was proved and accepted by the Surrogate. TEXT FROM PROBATE RECORDS Wyoming Co Wills Vol. 4 Page 37 Last Will and Testament of Thomas J WASHBURN, deceased. Be it Remembered, that, heretofore, to wit, on the twenty second day of January in the year of our Lord one thousand eight hundred and sixty one Junior T WASHBURN sole executor named in the last will and testament of Thomas J WASHBURN, late of Attica in the County of Wyoming deceased, appeared in open Court, before the Surrogate of the County of Wyoming and made application to have the said Last Will and Testament, which relates to Personal Estate approved and on such application the said Surrogate did ascertain by satisfactory evidence who were the heirs by law and next of kin of the said testator and their respective residences and said Surrogate did thereupon issue a Citation in due form of law directed to the heirs at law and next of kin requiring them to appear before said Surrogate at his office in the Village of Warsaw in the said County on the fourth day of February AD 1861 to attend the Probate of said Will. Afterwards to wit on the fourth day of February AD 1861 satisfactory evidence by affidavit was produced and presented to said Surrogate of the due service of said Citation in the mode presented by law, and on that day no one appearing to oppose the Probate of such Will such proceedings were thereupon had in said Court afterwards that the said Surrogate took the proofs of said Will hereinafter set forth, upon the fourth day of January AD 1861 and be thereupon adjudged the said Will to be a valid Will of Personal Estate, and the proofs thereof to be sufficient which said Last Will and Testament and proof are as follows, that is to say: Will. ? ? by this ? that I Thomas J WASHBURN of Attica in the County of Wyoming and State of New York being of sound mind and memory do make declare and publish this my last will and testament I give and bequeath to my nephews Jerome B. and Jerri T WASHBURN a hundred and twenty five dollars each if they shall have attained the age of twenty one years at my decease if not the same to be held in trust and kept at interest for them by my executor to be paid to them by said executor when they shall become of lawful age. I nominate and appoint my brother Junior T. WASHBURN to be the executor of this my last will and testament. WASHBURN, Deceased Wyoming County, SS Carni (?) T(?) LINDSLEY and Whitney (?) SCOVILLE both of Attica in the County of Wyoming and State of New York being first duly sworn in open court upon their several corporal oaths, each of himself doth depose and say, that they are subscribing witnesses to the last will and Testament of Thomas J. WASHBURN late of the town of Attica in the County of Wyoming and State of New York deceased. And these deponents do further say that the said Thomas J. Washburn deceased in the presence of each of these deponents, subscribe his name at the end of the instrument in writing, which is now here shown to these deponents and which purports to be the last Will and testament of the said deceased, and which bears date on the tenth day of January one thousand eight hundred and sixty. That the said deceased did at the time of his subscribing his name to the said instrument as aforesaid declare the same to be his last Will and Testament; and these deponents did thereupon subscribe their own respective names at the end of said instrument as attesting witnesses to the execution thereof, each at the request of the said deceased and in his presence, and in the presence of each other. That the said deceased at the time of so subscribing his name to said instrument as aforesaid, and publishing said instrument as aforesaid, was upwards of twenty-one years of age and a citizen of the United States; that he appeared to be, and deponents believe he was of sound mind, memory and understanding, and not under any restraint, and as deponents verily believe, in all respects competent to devise real estate; that each of these deponents saw the other sign his name to said instrument in the presence of the said deceased. COMSTOCK Surrogate It appearing upon the proofs duly taken in respect to the Last Will and Testament of Thomas J. WASHBURN late of the town of Attica in the County of Wyoming and the State of New York, deceased, that the said Will was duly executed, and that the said Thomas J. WASHBURN at the time he executed the same was in all respects competent to devise real estate, and not under restraint, the said Last Will and testament and the proofs and examinations are hereby recorded, signed and certified by me, pursuant to the provisions of the Revised Statutes, this fourth day of January AD 1861 H L COMSTOCK Surrogate. Transcriber note: The US Census records from Attica, NY 1850/60 indicate Thos. J or "Jefferson" WASHBURN was born in @1806, VT. The Death certificate of Junior T. WASHBURN (NY 1899 #27262) (brother named in the above will) names his parents as Reuben and Anna WASHBURN. (Possibly the Reuben WASHBURN and Anna VAUGHN married in Bridgewater, VT 31 Mar 1805. He maybe the Reuben WASHBURN whose birth record appears in the records of Woodstock VT as born Jun 5th, 1778 in Brookfield, MA) Reuben and Anna WASHBURN are also listed as the parents on the Death certificate (NY 1893 #8131) of Jerome B. WASHBURN (b July 23 1810 VT). A Reuben WASHBURN Junior was living with Reuben and Anna WASHBURN in the 1850 census. He died age 35, 31 Aug 1853. (Newspaper clipping dated 9 Sep 1853 pasted into a book at the Attica Historical Society) An Anna WASHBURN was also living with Reuben and Anna in 1850/1860 and with Anna Sr in 1970. These two younger Reuben and Anna are the same age in 1850, possibly twins? Reuben WASHBURN Sr died 13 Feb 1862 (another pasted newsclipping at the Attica Historical Society). Anna WASHBURN not located after 1870 census. Another possible child of Anna and Reuben: Calvin T WASHBURN. He was born in VT 1808. He lived in Attica. Census records indicate parents birthplaces matching those reported by Anna and Reuben and their other children. More information of any sort on this family would be greatly appreciated.
