Hatfield legatee and Leander L. Chaffee and said Albert H. Hatfield Executors named in the Last Will and Testament of Mason Hatfield late of the town of Wethersfield in the County of Wyoming and the State of New York, deceased, appeared in open court, before the Surrogate of the County of Wyoming and State of New York, and made application to have the said Last Will and Testament which relates to both Real and Personal Estate, proved; and on such application the said Surrogate did ascertain, by satisfactory evidence, who were the widow, heirs at law and next of kin of the said testator, and the irrespective residences. Appearing by the petition duly verified and filed in this matter that the said Harriet Hatfield is the widow and the said Albert H. Hatfield is the only heir at law and next of kin and said Mason Hatfield deceased testator and the said Harriet Hatfield and Albert H. Hatfield having petitioned to this court for the immediate proof and probate of said will without issuing of any citation and in that day, no one appearing to oppose the Probate of such Will such proceedings were thereupon had in said Court afterwards that the Surrogate took the proofs of said Will hereinafter set forth, upon this 6th day of January A.D. 1877, and he thereupon adjudged the said Will to be a valid Will of Real and Personal Estate, and the proofs to be sufficient, which said Last Will and Testament and proofs are as follows, that is to say: WILL In the name of God, Amen I, Mason Hatfield, of Wethersfield, Wyoming County, New York being of sound mind and memory, and considering the uncertainty of this frail and transitory life do therefore make, ordain, publish, and declare this to be my last Will and Testament, that is to say: First__After all my lawful debts are paid and discharged, I give and bequeath to my beloved wife Harriet Hatfield all my Real estate lying and being on the east side of the highway running North and South by my present residence to have and to hold the same in her own right forever. Second__I give and bequeath to my son Albert H. Hatfield all my real estate on the west side of said highway to have and to hold the same in his own right forever. Third__All my personal property of whatever kind is to be used and applied first in the payment of my debts, funeral expenses and the expense of settling up my estate and the balance of such personal estate is to be equally divided between my wife and son Albert H. Hatfield, if for any cause my personal estate should not be sufficient to pay my debts and the expenses above mentioned, then the payment of any deficiency I have upon the real estate hereby devised to my son. Likewise, I make, constitute and appoint my said son Albert H. Hatfield and my friend Leander L. Chaffee of Warsaw, New York to be executors of this my last Will and Testament thereby revoking all former Wills by me made. In Witness Where of I have hereunto subscribed my name and affixed my seal the fourteenth day of December in the year of our Lord one thousand eight hundred and seventy six. Mason Hatfield L.S. C. T. Bartlett Warsaw A. J. Wheeler Wethersfield SURROGATE'S COURT---Wyoming County. In the matter of proving the Last Will and Testament of Mason Hatfield Deceased. Wyoming County---ss Cosam T. Bartlett and Andrew J. Wheeler being first duly sworn in open Court, upon their several corporeal oaths, each for himself doth depose and say, that they are subscribing witnesses to the Last Will and Testament of Mason Hatfield late of the town of Wethersfield in the County of Wyoming and State of New York deceased. And these deponents do further say, that the said Mason Hatfield deceased, did, in the presence of each of these deponents, subscribe his name at the end of the instrument in writing which is now here shown to these deponents, and which purports to be the Last Will and Testament of the said deceased, and which bears date on the 14th of December one thousand eight hundred seventy six. That the said deceased did, at the time of subscribing his name to the said instruments as aforesaid, declare the same to be his Last Will and Testament; and these deponents did thereupon subscribe their own respective names at the end of said instrument, as attesting witnesses to the execution thereof, each at the request of the said deceased, and in his presence and in the presence of each other. That the said deceased, at the time of so subscribing his name to said instrument as aforesaid, and publishing said instrument as aforesaid, was upward of twenty-one years of age, and a citizen of the United States; that he appeared to be, and deponent believes he was, of sound mind and memory and understanding, and not under any restraint, and as deponents verily believe, in all respects competent to devise real estate; that each of these deponents saw the other sign his name to said instrument in the presence of the said deceased. Healey Surrogate Wyoming County---ss, It appearing upon the proofs duly taken in respect to the Last Will and Testament of Mas `n Hatfield late of the town of Wethersfield in the County of Wyoming and State of New York, deceased, that the said Will was duly executed, and the said Mason Hatfield at the time he executed the same was in all respects competent to devise Real Estate, and not under restraint, the said Last Will and Testament and the proofs and examinations are hereby recorded, signed, and certified by me, pursuant to the provisions of the Revised Statutes, this 6th day of January A.D. 1877.
