True, sole Executor named in the Last Will and Testament of William Whiting, late of the town of Castile in the County of Wyoming and State of New York, deceased, apopeared in open court, before the Surrogate of the County of Wyoming and State of New York, and made application to have the said Last Will and Testament which relates to both Real and Personal Estate, proved; and on such application the said Surrogate did ascertain, by satisfactory evidence, who were the heirs at law and next of kin of the said testator, and their respective residences. And said Surrogate did thereupon issue a Citation, in due form of law, directed to the heirs at law and next of kin of William Whiting, said testator, by their respective names, stating their respective places of residence requiring them to appear before said Surrogate at his office in the village of Warsaw, in said County, on the 6th day of March, A.D. 1876, to attend the Probate of said Will. And afterwards, to wit: on the 6th day of March, A.D. 18876, satisfactory evidence by affidavit was produced and presented to said Surrogate, of the due service of saaid Citation in the mode prescribed by law, and in that day, no one appearing to oppose the Probate of such Will such proceedings were thereupon had in said Court afterwards that the Surrogate took the proofs of said Will hereinafter set forth, upon this 6th day of March A.D. 1876, and he thereupon adjudged the said Will to be a valid Will of Real and Personal Estate, and the proofs to be sufficient, which said Last Will and Testament and proofs are as follows, that is to say: WILL. In the name of God. Amen. I William Whiting of Castile in the county of Wyoming and State of New York, of the age of eighty-three years and upwards and being of sound mnd and memory do make publish and declare this my last will and testament in manner following that is to say First. I give devise and bequeath to my son Philander Whiting and my Grand daughter Eliza Jane Scribner, daughter of Jay Scribner of Castile N.Y. all my real estate situate in Castile aforesaid and bounded and described as follows. To wit; All that certain tract in parcel of land situate in the town of Castile in the County of Wyoming and State of New York and being a part of Lot No.26 of Elisha Johnsons subdivision of the Cottringer Tract in said town and known as the Severance Lot and premises consisting of fifty acres more or less. Being the same premises on which the said William Whiting now resides and bounded south by the noth line of said Lot, on the South by the north line of lands owned by Ira True, on the west by lands owned and occupied by Rufus Peet and on the east by lands owned and occupied by Willis C. Felch in the propotion of three fifths to the said Philander Whiting and two fifths to the said Eliza Jane Scribner. I also give and bequeath to the said Philander Whiting and Eliza Jane Scribner all my household furniture and household goods of every name nature and kind whatsoever usually kept or used on said premises also my teams, working tools agricultural implements, and personal property usually kept or used on said premises of every name mature and kind whatsoever, except money and moneyed obligations to be divided equally between them share and share alike, the same to be held and enjoyed by the said Philander Whiting and Eliza Jane Scribner jointly as common property, neither to have the privilege of disposing of any part of said property either real or personal without the consent in writing of the other. Second. All the rest residue and remainder of my estate of which I shall die seized remaining after the payment of my just debts, funeral expenses and the costs and charges of executing this my last will and testament I give, devise and bequeathe to my children heiirs of my body named as follows Price Whiting, Lezana Scribner, Bethana Logan, Ruana Griffith, Calistana Griffith, Chauncey Whiting, Alexander Whiting and Philander Whiting to be divided equally amoung them share and share alike. And Lastly. I hereby nominate and appoint my friend Stephen C. True of Castile N.Y. to be the executor of this my last will and testament hereby revoking all former wills by me made.
