To the Yates County Circuit Court : THE PETITION OF Harold Ellerington of the town of Italy , County of Yates, respectfully shews that your Petitioner, as he is informed and believes, was born in Yorkshire, England And is now the age of 47 years, and that he was a subject of the Queen of England to whom he owed allegiance; that he emigrated to the United States at least five years ago, and he has ever since resided within the United States, and has not for more than five years now past resided out of, or been out of the United States, at any time during the said five years, and for more than one year now last past, he has been a resident of the State of New York; That it has been his bona fide intention for more than five years, now last past, to become a citizen of the United States of America, and that in pursuance of such intentions, he did on the 19th day of April, 1855 make and subscribe his declaration of such intention, which declaration was made and filed pursuant to law, and in which is now on file in Yates Co., Clerks Office and to which he prays leave to refer. Your petitioner therefore prays that he may be admitted to all the rights and benefits, privileges and immunities of a citizen of the United States of America, pursuant to the provisions of the Acts of Congress, in such case made and provided, and to be naturalized as such citizen upon producing satisfactory proof of his good moral character, and attachment to the principles of the Constitution of the United States, and that he is well disposed to the happiness and good order of the same, and upon taking the oath to support the said Constitution, and to renounce allegiance as aforesaid, as is further required by the provisions of the said Acts of Congress. Van Alen of Penn Yan in the County of Yates in the State aforesaid, having been duly sworn, depose and say, each for himself, that they are citizens of the United States, that they are well acquainted with Harold Ellerington that he has resided in the United States for five years last past, and not elsewhere, and for the last year in the State of New York, and during all that time has behaved as a man of good moral character, attached to the principles of the Constitution of the United States, and well disposed to the good order and happiness of the same. Clerk I, Harold Ellerington, do solemnly swear, that I will support the Constitution of the United States, and that I hereby entirely renounce and abjure all allegiance and fidelity to every foreign prince, potentate, state, and sovereignty whatever, and particularly to the Queen of England of whom I am a subject. The said applicant having made application to this court to become a citizen of the United States, and it appearing that he said applicant two year, made the declaration required by law, and it appearing to the full satisfaction of this court to fact he has complied in all respects with the laws of the United States in relation to naturalization, and the court being satisfied that of the said application has resided in the United States, for at least five years immediately preceding this application, and that during that time he has behaved as a man of good moral character, attached to the principles of the Constitution of the United States and well disposed to the good order and happiness of the same, and the said applicant having appeared in open court and taken and subscribed the oath that he will support the Constitution of the United States and of abjuration required by law: ordered, that the said Harold Ellerington be and he is hereby admitted a citizen of the United States and any of them.
