YATES SURROGATE'S COURT: IN THE MATTER PROVING THE WILL OF Finch F. Randolph, Deceased. To the Surrogate of the County of Yates: The Petition of Daniel F. Randolph of the Town of Torrey in the County of Yates respectfully shows: That Finch F. Randolph, late of the Town of Milo in the said County of Yates, is now dead; That the said deceased was ~ immediately previous to his death, an inhabitant of the said County of Yates, and died at the Town of Torrey ~~~~~~ on the 22nd day of September 1858; That said deceased, in his lifetime and on ~~~~~ the 17th day of September 1858, made and published his last will and testament ~~~~~~~~~ in due form of law, which relates to real and personal estate; That your petitioner is named therein as the sole executor thereof. That the ~~~, heirs at law and next of kin of the said Finch F. Randolph deceased are: Elizabeth Briggs, wife of Thomas Briggs residing at Naples, Ontario County, NY; Mary Ludlow, wife of John Ludlow, residing in the Town of Milo, Yates Co.; Lucy Ludlow, wife of Charles Ludlow residing somewhere in the State of Michigan but the particular place unknown to the Petitioner; John F. Randolph residing in the Town of Milo, aforesaid county; Almira Randolph, residing in Starkey; Jane Ann Randolph, residing in Torrey, Yates Co., Hellen Augusta, residing in Milo, aforesaid Co.: That the deceased left no widow, that said John F., Almira, Jane Ann, and Hellen Augusta are minors, having no general guardian and the whole estate will not, in the of your petition, exceed the sum of two thousand dollars ~~~ ~~~ ~~~ ~~~ Your Petitioner therefore prays that the usual order may be entered, that a citation may issue out of the Surrogate's Court of Yates County, in due form of law to be directed to the above named ~~~ heirs at law and next of kin of said deceased, to attend the probate of the said last will and testament.
