Probate: 5 October 1833 State of New York Yates County /ss Be it remembered that on the fifth day of October in the year of our Lord one thousand eight hundred and thirty-three personally appeared before me: Andrew F. Oliver, Surrogate of the County of Yates aforesaid, Roderick N. Morrison, one of the subscribing witnesses to the Will of Jesse Dains, late of the Town of Milo in the said county, deceased, who being duly sworn, declared that he did see the said Jesse Dains, deceased, seal and execute the instrument thereunto annexed and impressed with the seal of office of the said Surrogate, which said instrument purported to be the last Will and Testament of the said Jesse Dains deceased bearing date the 20th Day of June, 1833. That he heard him the said Jesse Dains publish and declare the same to be his last Will and Testament, and that at the time thereof, he the said Jesse Dains, was of sound disposing mind and memory to the best knowledge and belief of him the said Rodrick N. Morrison, and that he together with Benjamin Rider and Horace Nichols, the other witnesses to said Will, did severally subscribe their names thereto as witnesses in the presence of the testator. In witness wherof the said Surrogate hath hereunto set his hand and affixed his seal of office. Done at the Village of Penn Yan, this 5th day of October in the year of our Lord one thousand eight hundred and thirty three. Andrew F. Oliver ( L.S) Surrogate Know all men by these present that I, Jesse Dains of the Town of Milo in the County of Yates, being infirm in health do make and publish this my last Will and Testament in manner following: I give to my wife Chloe all my personal property which I may leave at my decease to her sole use, benefit and behoof, and to be disposed of in such manner as she may think proper, and I hereby appoint said Chloe sole executrix of this my last Will and Testament hereby revoking all former wills by me made. In testimony whereof I, the Testator, do hereunto set my hand and seal in presence of the subscribing witnesses, and we the subscribing witnesses have subscribed our names in presence and at the request of the testator and of each other this 20th day of June, 1833.
