Eighteen Hundred and Sixty two. J.D. Jones Judge of said Court and acting as his own Clerk. Amongst the orders of said Court on said day was on of which the following is the record. On motion the last Will and Testament in writing signed by the maker thereof Noah Kissel late of said county, deceased, was this day brought before the court. Thereupon came John Singer and Conrad Lipper subscribing and credible witnesses thereto who were duly sworn and examined by me, whose testimony was reduced to writing signed by them and filed with said Will, and it appearing to the court from said testimony that said last Will and Testament was duly executed, and that said Testator at the time of executing the same was of full age, sound mind and memory and not under any restraint. It is therefore ordered by said court that said last Will and Testament together with the Probate thereof be recorded in a Book kept by the Judge of this court for that purpose. And on the same date came into the court Elizabeth Kissel widow and relict of Noah Kissel, deceased, and after hearing read to her the last Will and Testament of her deceased husband and her rights under the same as well as under the laws fully explained, she did of her own accord elect to take under and by virtue of the provisions made for her in said last Will and Testament. Will and Proof I Noah Kissel, of the County of Ashland in the State of Ohio do make and publish this my last will and testament in manner and form following, that is to say: First it is my will that my funeral expenses and all just debts be fully paid. Second, I give, devise and bequeath to my beloved wife Elizabeth in lieu of her dower, the plantation on which we now reside, situate in Orange Township Ashland Co. Ohio containing about fifty acres during her natural life and all the live stock, horse, cattle, sheep, hogs, and everything which I own, or have any claim to, or any interest I may have in anything on or off the farm. Also all the household furniture and other items not particularly named and otherwise disposed of in this will during her natural life as aforesaid. She however first disposing of a sufficiency thereof to pay my just debts as aforesaid. And at the death of my said wife, all the property hereby devised or bequeathed to her as aforesaid, or so much thereof as may remain unexpended to my children which may be alive at the death of my said wife. And lastly, I hereby constitute and appoint Dr. Thomas Hays to be the Executor for this my last will and testament, and ratifying and confirming this and no other to be my last will and testament. In testimony whereof, I have hereunto set my hand and seal, this Fifteenth day of Feb. A.D. 1859. Noah Kissel Signed, published and declared by the above named Noah Kissel as and for his last will and testament, in presence of us, who at his request have signed as witnesses to the same. John Singer Conrad Lipper The State of Ohio Ashland County Personally appeared in open Court John Singer and Conrad Lipper subscribing witnesses to the last Will and Testament of Noah Kissel late of said County, deceased, who being duly sworn according to law depose and say that the foregoing is the last Will and Testament of said Noah Kissel, deceased, that they subscribed their names thereto as the attesting Witnesses at the request of the said Testator, and in his presence and in the presence of each other, and that he signed the same in our presence, and acknowledged the same to be his last Will and Testament; that said Testator at the time of executing the same was of full age, sound mind and memory, and not under any restraint.
