I Peter King of the town of Salem in the County of Ashtabula and State of Ohio, farmer __ being infirmed in body, but of perfect mind, and memory for which I thank God calling into mind the mortality of the body and Knowing it is appointed for all men once to die, do make and ordain this my last Will and testament ___ That is to say principally and first of all I give and reccommend my soul into the hand of Almighty God that gave it and my body I reccommend to the earth to be buried in descent Christian burial at the discretion of my executors nothing doubting but at the general resurrection I shall receive the same again by the mighty power of God. And as touching such worldly estate wherewith it hath pleased God to bless me in this life I give devise and dispose of the same in the following manner and form ___ First I give and bequeath to my dearly beloved Wife Mehatabel the improvement of one equal half of all my land together with all my household goods and the use of two good Cows and five good Sheep during her life Also I give to my well beloved daughter Mercy the sum of one dollar lawful money of the United States Also I give my well beloved daughter Unice the sum of one dollar lawful money of the United States Also I give to my sons Elisha Nehemiah and Nathan one dollar a piece lawful money of the Unites States Also I give to my well beloved daughter Rebekah one dollar lawful money of the United States Also I give to my son Peter the sum of one dollar lawful money of the United States and I Also give to my son Benjamin Howard King whom I constitute make and ordain the sole executor of this my last Will and testament and singular my lands Chattels and tenements by him freely to be possesed and enjoyed also all the property before mentioned willed to my beloved wife Mehetabel at her decease except one dollar to my several heirs as above mentioned which is to be levied of my goods and Chattels at my decease ___ I ratify and Confirm this to be my last will and testament in Witness whereof I have hereunto Set my hand and Seal this thirteenth day of Febuary in the year of Lord one thousand eight hundred and seventeen ___ Signed Sealed published pronounced and declared by the said Peter King as his last Will and testament in his presence and in the presence of each other have hereto subscribed our names Wm Gould Peter King Hannah Gould David Gould Be it known by all men by these presents that I Peter King of the town of Salem in the County of Ashtabula and State of Ohio have made and declared my last Will and testament in Writing bearing date the thirteenth of February in the year of our Lord one thousand eight hundred and seventeen I the said Peter King by these presents Codicil do ratify and and confirm my said last Will and testament and do further give and bequeath unto Alma Vinson Hannah Vinson and Joseph Vinson the sum of one dollar a piece lawful money of the United States to be paid unto them the said Alma Vinson Hannah Vinson and Joseph Vinson by my executor out of my estate and my will and meaning is that this codicil be adjudged to be a part and parcel of my last Will and testament and that all things therin mentioned and contained be faithfully and truly performed and as fully and amply in every respect as if the same were declared and set down in my said last Will and testament Witness my hand this fifteenth day of May one thousand eight hundred and eighteen signed in presents of us _____ Wm Gould Peter King Reuben Kellogg Hannah Gould Which said Will and Codicil being Clearly and legally proven by Wm Gould Hannah Gould two of the subscribing Witnesses the same was accepted by the Court and ordered to be recorded. And it appearing by said last will and testament that the said Benjamin Howard King is appointed executor thereof ___ the said Benjamin Howard King appeared in Court and accepted and undertook said trust and was duly sworn in open Court. The Court appointed Aaron Wright Zaphna Lake and Gould Sawtell Appraisers to appraise the personal property belonging to said estate And thereupon on the twelfth day of November in the year of our Lord one thousand eight hundred and twenty eight a letter testamentary Issued from the office of the Clerk of said Court under the seal thereof in the words and figures following (to which letter testamentary a true and certified copy of said last Will and Codicil were affixed (Viz) The State of Ohio Ashtabula County ss. The Honorable George Tod Esquire President of the third circuit of the Court of common Pleas and Amos Kellogg Titus Hayes and Jonathan Gregory his associates Judges of the same Court Within and for the County of Ashtabula aforesaid in the name and by the authority of the State of Ohio, to all whom these presents shall come Be it known That before said Court was proved and approved the last will and testament of Peter King of Salem towhship in the County aforesaid deceased (a true copy whereof is to these presents annexed) having whilst he lived and at the time of his decease, divers goods, chattels, rights and credits within said County; by reason whereof the approbation and insinuation in the said, last Will and testament and the committing the administration of all and singular the goods, chattels and credits which were of the said deceased and also the auditing the accounts calculations and reckoning of the said Administration and final dismission from the same to said Court are manifestly known to belong; and that the Administration of all and singular the goods chattels rights and Credits of the said deceased any way concerning his last Will and testament was committed to Benjamin Howard King of Salem township in the County aforesaid executor in the said testament, named Benjamin Howard King having been first duly sworn well and truly to administer the goods, chattels rights and credits of the said deceased and make a true and perfect inventory thereof appraised by Aaron Wright Zaphna Lake and Gould Sawtell freeholders of the County aforesaid and make a return thereof (signed by the appraisers) with a bill of the sale of the goods and chattels of the said deceased together with a true and accurate statement of the debts due and oweing to the estate of the said Peter King deceased to the Office of the Clerk of the Court of Common Pleas aforesaid, within three months from the date hereof, and moreover to adjust and settle up the accounts of his administration within Eighteen months from the date hereof as the law directs; and we do by these presents appoint the said Benjamin Howard King executor of all and singular the goods, chattels, rights and credits which were of the said Peter King deceased ____ In testimony of which we have caused the Seal of our said Court to be hereunto Affixed ___ Witness the Honorable George Tod, President S S thereof at Jefferson in said County the twelvth day of November Anno Domini One thousand Eight hundred and twenty Eight Sam Hendry Clerk Which said Letter Testamentary and Copy of Will returned to the said Benjamin Howard King on the twenty second day of November in the year of our Lord one thousand Eight hundred and twenty Eight; on which day the said Benjamin H. King filed in the Office of the Clerk of said Court his Bond in the words and figures following, to wit __ Know all men by these presents that we Benjamin Howard King as principal and Ezekiel Olds and William G Sawtell as sureties of the County of Ashtabula in the state of Ohio are held and firmly bound unto the State of Ohio in the penal sum of five hundred dollars lawful money of the United States, to which payment well and truly to be made unto the said State of Ohio, we do bind ourselves our heirs Executors and Administrators and were of Jointly and severally firmly by these presents ___ Sealed with our seal and dated 21st day of November Anno Domini one thousand Eight hundred and twenty Eight ___ The condition of this obligation is such that whereas the above bounden Benj Howard King was on the 4th day of November AD 1828 appointed Executor of the last Will and testament of Peter King late of Salem in said County deceased and that in case the said Benj. Howard King shall well and truly perform said Will by paying first the debts and then the legacies contained in said will as far as the goods chattels and credits of the testator will extend and as far as the said B. H. King will by the law stand chargeable and shall also make or cause to be made a true and perfect inventory of all the goods chattels and credits of the said testator which have or shall come to the knowledge hands or possession of said Executor or in to the hands or possession of any other person or persons for him (signed by the appraisers mentioned in the letters Testamentary) and return the same together with a bill of the sale of the Goods and Chattels of the said deceased and also a true and accurate statement of the debts due and owing to the Estate to the Office of the Clerk of the Court of said County within three months from the date hereof And moreover make or cause to be made a true and just account of his administration on or before the 5th day of May AD 1830 and do administer agreeably to the statutes of the state of Ohio, in such case made and provided then this obligation to be null and void otherwise to remain in full force and virtue Signed sealed and delivered in presence of B. King Executor __ And thereupon it was Ordered that the said Accounts together with the accompanying Vouchers remain on the files of the Court for Examination until the next term___ Afterwards at a term of said Court began and held at Jefferson aforesaid on the Twelvth day of April in the Year of our Lord One thousand Eight hundred and thirty before the Honourable Reuben Wood President and Titus Hayes and Jonathan Gregory Esquires Associates came the Executor aforesaid and the Court having seen and examined the Accounts of his Executorship and being Satisfied that the proceedings in this behalf have been had in all respects according to Law, the same are accepted as a final Settlement of said Estate ____ Attest Sam Hendry Clerk
