All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/oh/ohfiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Mary Zednick mzednick@3rivers.net February 20, 2004, 8:29 pm Source: SAMPUBCO - Ashtabula County, Ohio Will Book Vol. D2, page 361 Written: December 6 1873 In the matter of Titus Brown's Will Be it remembered that heretofor to wit at the Probate Court held at the Court House in the Village of Jefferson within and for the County of Ashtabula in the State of Ohio on the fourth day of August in the year of our Lord one thousand eight hundred and seventy six, the last Will and Testament of Titus Brown late of Morgan deceased was produced in open Court for probate which said Will follows in those words and figures into ??of our benevolent Father: I Titus Brown of Morgan Township county of Ashtabula and state of Ohio, being of sound mind and in the right use of my senses on this sixth day of December in the year of our Lord one thousand eight hundred and seventy three, make this my last Will and Testament to wit: I will and bequeath that my daughter Lucy Brown shall have the twenty nine and one fourth acres of land described as follows: situate in the township of Morgan, county of Ashtabula and State of Ohio, being a part of lots Nos 46 and 47 in said township. Bounds in the west by the old turnpike road running from Ashtabula to Warren, on the north by lands owned by Charles and Fayette Woodruff, on the East by the A.Y&P Rail Road, and on the south by a line running parallel with the north line to contain twenty nine and one fourth acres of land. Second: I will that my daughter Sophia White shall have the fifteen acres of land in the aforesaid township, county, and state described as follows: Being a part of lots Nos. 46 & 47 and is bounded as follows: on the West by land of G. Hanna(?), on the south by land occupied by Mr. Martin, Caleb Chapman and George Askew, on the east by the A.Y.P Rail Road, and on the south by the land above willed to Lucy Brown. I also will that James Brown my son and Aaron Brown my son and my daughter Alvira Wilson and Celia Arthor have had their full share of all my estate. I also appoint James Brown, my son, my sole administrator. Signed by me in the presence of the following witnesses Titus Brown – And by us in the presence of the said Titus Brown this 6th day of December 1873 Mary F Askew J.B. Bartholomew. Thereupon came J.B. Bartholomew and Mary F. Askew the subscribing witnesses to said Will, who being duly sworn according to law testified to the due execution of the same. Which said testimony was reduced to writing and filed herein and follows in these words and figures to wit: State of Ohio Ashtabula County of Probate Court. Personally appeared in open Court J. B. Bartholomew and Mary F. Askew the subscribing witnesses to the last Will and Testament of Titus Brown deceased, who being duly sworn according to the law to speak the truth, the whole truth and nothing but the truth in relation to the execution of said Will, depose and say that the paper before them purporting to be the last Will and Testament of Titus Brown deceased is the Will of said deceased, that they were present at the execution of said Will, at the request of the Testator subscribed their names to the same as witnesses in his presence, and that they saw the said Titus Brown deceased sign and seal said Will and heard him acknowledge the same to be his last Will and Testament. That the said Titus Brown at the time of making, signing and sealing said Will was of legal age and of sound and disposing mind and memory, and under no undue or unlawful restraint what so ever. Betts Probate Judge And it appearing that said will was duly executed and attested: that said Testator at the time of executing the same was of sound and disposing mind and memory, of legal age and under no restraint said Will admitted to probate and with said testimony ordered of record.
