Item first. It is my will that all my just debts and charges be paid out of my estate. Item Second. I give and bequeath to my three daughters Abby Perkins, Elizabeth Ward, and Rebecca Beach and their heirs all the residue of my personal estate of every kind after deducting sufficient to pay my debts and the charges against my estate to take, share and share alike. Item third. I give and devise to my two sons Lorenzo Moore and Jacob Moore and their heirs the following described real estate to wit; situate in the County of Belmont and state of Ohio and First Tract being the north west quarter of section No. twenty eight (28) of township no. five (5) of Range No. four (4) except nine acres more or less heretofore deeded to Reuben Perkins. Second Tract being the west half of the south east quarter of section No. thirty four (34) of township five (5) and range four (4) containing eighty acres more or less; third tract being a part of the north east quarter of said section No. thirty four (34) and lying on the south side of Captina Creek and on the west side of the Piney Fork of said creek, the center of said creek being the northern boundary of said tract & containing nineteen (19) acres more or less. Fourth Tract, being about nine (9) acres described as follows, beginning for the same at the south east corner of the south west quarter of said section No. thirty four (34) thence north two hundred and twenty two perches to the middle of Captina Creek thence west six rods thence south two hundred and twenty two perches thence east six rods to the place of beginning – Fifth Tract, being a part of said section No. thirty four (34) and beginning for the same at a point in the middle of Captina Creek six rods west of the line dividing said section thence South 58 32/100 rods to a stone thence south 70O west 76 rods to a buckeye tree thence down a little ravine north 11O East 806 rods thence north 69O West 14.32 rods thence North 2O East 8.28 rods; thence northe34o West 8.88 rods to the middle of said Captina Creek thence north 61O East 66.36 rods; thence north 54O East 20.64 rods to the place of beginning Containing 21 acres three roods and fifteen perches more or less. Sixth Tract, being known as the “saw mill tract” and was deeded by Charles Wheeler and wife to Milton Danford by deed recorded February 22d, 1853 at pages 25 and 26 of Vol 37 of the records of deeds of Belmont County. The first tract above described is known as my “Home Farm” the second third fourth and fifth tracts are know as the “Piney Farm” and the sixth tract is known as the saw mill tract,. It is my desire that my said sons Lorenzo and Jacob shall divide said lands between themselves as they may deem best. Item Fourth: It is my will and desire that my said sons Lorenzo and Jacob shall have all my real estate in manner and form as above described subject to the following conditions, first that each one of my said sons shall within one year from the time they become seized of said real estate pay to each one of my daughters viz. Abby Perkins, Elizabeth Ward and Rebecca Beach, the sum of twenty five dollars, Second they shall within said time pay to each one of the following named of my grand children the children of my deceased son Alexander, namely Elsadora Moore, Desdamonia Moore Arizona Moore and Emmet Moore the sum of ten dollars. Item Sixth. I hereby revoke all former wills by me made. In testimony whereof I have hereunto set my hand and seal the 11th day of June A.D. 1878 Amster Moore.
