After payment of my just debts and charges I give and devise as follows: 1st I give and devise to my duaghter Elizabeth Major one hundred and fifty dollars one year after my decease, 2nd To my daughter Sarah Marlow one hundred and forty dollars in two years after my decease. 3rd To my daughterJane McCoy one hundred and forty dollars in three years after my decease. 4th I give and devise to my sons Samuel Moore & Clark Moore and to my grand sons John C. Moore, Joseph Moore, James Moore and Thomas Moore and to my Grand daughter Isabell Jane Moore, (heirs of my son James Moore deceased.) each one copy of the Bible. 5th I devise and bequeath to the Reformed Dissenting Presbytery fifty dollars. 6th I devise and bequeath to my son Joseph Moore his heirs and assignees the farm on which I now reside situate in Peas Township Belmont County and State of Ohio, containing One hundred and forty since acres more or less, and all the stock,house-hold goods, furniture, provisions and other goods and chattels which may be theron at the time of my decease. 7th I do hereby nominate and appoint Joseph More Jr. and Samuel Moore, Executors of this my last will and testament. I do hereby revoke all former wills by me made. In testimony whereof I have hereunto set my hand and seal this twentieth day of November One thousand Eight hundred and forty nine. Signed and acknowledged by said Joseph Moore as his last will and testament in our presence Joseph Moore seal and signed by us in his presence Saml McConahey, Thomas Mitchell. Probate The State of Ohio, Belmont County SS. Probate Court May 16th 1859. The last will and testament of Joseph Moore Senr late of Belmont County of Ohio, deceased, was this day brought into the Probate Court of said County and presented for the probate, and it appearing to satisfaction of the Court by the testimony of Samuel Mc Conahey and Thomas Mitchell the subscribing witnesses to said will this day taken in open Court, reduced to writing and filed, that said will was duly attested and executed, that the testator at the time of executing the same was of sound mind and memory, of full age and not under any restraint. Therefrom the Court approve said will and order that said the same be recorded with the proof now taken to prove the same. On motion the Court order that letters testamentary on said estate issue to Joseph Moore one of the Executors named in said will (the other declines serving) upon his giving a residuary legatee bond with security in the sum of Two thousand dollars conditioned according to law, and Samuel Moore and David S. Jennings being offered are accepted as such Security bond filed and letters issued same day. Robert Claudy, Probate Judge// Evidence The State of Ohio Belmont County SS. on the 16th day of May AD 1859 appeared before the Judge of the Probate Court of said county, Samuel Mc Conahey and Thomas Mitchell the subscribing witnesses to a paper writing this day presented to said Court for probate, perporting to be the last will and testament of Joseph Moore late of said county, deceased, came into Court and each being solemnly sworn in open Court, The said Samuel McConahey for himself upon his solemn oath saith that he saw the testator sign the said paper writing as and for his last will and testament, that he subscribed the same as a witness thereunto in the presence of the testator and at his request; that the testator at the time of the signing was of sound mind and memory twenty one years of age and not under any restraint. Sml Mc Conahey The said Thomas Mitchell for himself upon his solemn oath saith that he saw the testator sign said will, that he subscribed the same witness thereto in the presence of the testator and at his request; the testator at the time of signing said will was of sound mind and memory twenty one years of age, and not under any restraint. Thomas Mitchell Taken, reduced, to writing and subscribed in open Court, at my office St Clairsville this 16th day of May AD 1859. Attest.
