The Will of James Ireland In the name of God, amen, this first day of November in the year of our Lord one thousand eight hundred and forty two. I James Ireland of Wayne Township, Belmont County, Ohio, being sick and weak in body but of perfect mind and memory thanks be to God; therefore calling unto mind the mortality of my body and knowing that it is appointed for all men once to die, do make and ordain, this my last will and testament, that is to say, principally, and first of all, I recommend my soul to God who gave it, and my body to the earth, to be buried in a christian like manner at the discretion of my executors herein after named --- and as touching such worldly estate wherewith it hath pleased God to bless me in this life, I give devise and dispose of the same in the manner and form following. 1st that all my debts be paid in a convenient time after my decease. 2nd I give and bequeath to my children Anne, Thomas, Sarah, Susannah, Mary Jane, Hannah, Dolly and Hamilton Ireland all my moveable property after my debts are satisfied, each one share and share alike, and likewise the above named legatees to have the use of the farm whereon I reside for the term of three years (clar from sent) after my decease, and then the farm to be sold at the expiration of the term and one hundred dollars of the money arising from the sale of the land to be equally divided among the above named legatees. 3rd I give and bequeath to my son Thomas M. Ireland one hundred dollars in money arising from the above source. 4th I give and bequeath the balance of the money arising from the sale of my real estate to all my children Johnston, George, Ann, Sarah, Susannah, Mary Jane, Hannah, Dolly, Thomas, Hamilton Ireland to be divided equally among them share and share alike. I likewise constitute and ordain my son Johnston Ireland my sole executor of this my last will and testament, disannulling all former will or wills heretofore by me made confirming this and no other to be my last will and testament. In witness whereof I have hereunto set my hand and seal this first day of November one thousand eight hundred and forty two. James Ireland {Seal} Signed, sealed, published and declared by the said James Ireland to be his last will and testament in the presence of us --- George Ireland Thomas M. Ireland Entry of Probate The State of Ohio, Belmont County Court of Common pleas of said county March term A.D. 1843 This day was brought into court and presented for probate a paper writing purporting to be the last will and testament of James Ireland late of the county of Belmont deceased; and it appearing to the court by the testimony of George Ireland and Thomas M. Ireland the subscribing witnesses to said will, taken in open court, reduced to writing and filed, that said will was duly attested and executed, that the testator at the time of creating the same was of sound mind and memory, of full age and not under any restraint: We hereupon the court approve said will and order that the same be recorded with the proof now taken: And on motion of Daniel Peck Esquire, the court appoint Benjamin Lane administrator with the will annexed of James Ireland deceased, the said Johnston Ireland who is named in said will as the executor thereof, having in open court here declined taking upon himself the execution of said will: and order that letters issue to him upon his giving bon a with security in the sum of twenty six hundred dollars conditioned according to law and William H Guion and John W Trott being offered are accepted as such security. The court appoints Benjamin Loper, Thomas Tilcher and James Powell appraisers of the estate and effects of said deceased. Evidence The Sate of Ohio, Belmont County Court of Common pleas of said County March term A.D. 1843 George Ireland and Thomas Ireland the subscribing witnesses to a paper writing this day presented to the said court for probate, purporting to be the last will and testament of James Ireland late of said county deceased, came into court and each being solemnly sworn in open court; the said George Ireland for himself upon his solemn oath saith that he saw the testator sign said will, that he subscribed the same as a witness thereto in the presence and at the request of the testator; that the said testator at the time of signing said will was of sound mind and memory, twenty one years of age and not under any restraint. George Ireland And the said Thomas Ireland for himself upon his solemn oath saith that he heard the testator acknowledge the signing said will; that he subscribed the same as a witness thereto in the presence of the testator and at his request; that the said testator at the time of signing said will was of sound mind and memory, twenty one years of age and not under any restraint Thomas Ireland Taken reduced to writing and subscribed in open court this 10th day of March A.D. 1843 Attest John C Tallman Clerk I certify the foregoing to be a true record of the will of James Ireland deceased and of the entry of probate thereof and the evicence to prove the same.
