Smith and sent to Miss Alta Hazel Burnett "I Robert Henderson of Belmont County Wheeling Township and State of Ohio, Being weak in body but of sound mind and memory (blessed be Almighty God for the same) do make nad publish this my last Will and Testament in the manner and form following: Which I will and order that after my decease so much of my personal estate as can be spared of the farm be sold and if the money arising from the sale should not be sufficient to pay my debts and funeral expenses I will and odrder that as much of my real estate as will pay all my debts be sold. Also I will and bequeath to my beloved wife Margaret the one third of my real estate during her natural life. Also over and above, the best horse, one bed and bedding, one bureau, one corner cupboard with its furnature. Also I will and order that when my youngest child arrives at age sixteen years of age that all my real estate by sold and my beloved wife to receive the one third of the interest of the money arising from the sale, the remainder to be divided equally among my children, share and share alike, allowing to each one of them a larger proportion according to their labour given for the support of the family. But should my beloved wife Margaret again marry I will and Order that then my real estate be sold and divided as above specified. Also I will and order that hte mansion house that I now occupy be repaired by erecting a double chimney and the expense be defrayed as my other debts. And I appoint my beloved wife Margaret and my trusty friend Joseph Lyons the sold executors of this my last will and testament, and should any dispute or controversy arise with regard to anything expressed or understood in this my last will and testament, then I will and order that no legal process shall be instituted but that the executors of this my last will and testament shall appoint three freeholders of reputable character and their division shall be decisive and binding in all cases of controversy. And I hereby revoke all former wills. Given under my hand and seal this twelfth day of July in the year of our Lord, one thousand eight hundred and twenty three.
