All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/oh/ohfiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Linda Deppner http://www.genrecords.net/emailregistry/vols/00012.html#0002870 October 6, 2010, 10:11 pm Written: June 1, 1826 Recorded: June 2, 1826 Brown County, Ohio Deed Book E5, pages 249-250 Alexander to Devore This Indenture made this first day of June in the year of our Lord one thousand eight hundred and twenty six between James Alexander and Nicholas Devore Senior all of the county of Brown and State of Ohio Witnesseth that the said James Alexander for and in consideration of the sum of one hundred and ten dollars with interest from the first day of May one thousand eight hundred and twenty six until paid by the said Nicholas Devore Sen. the receipt whereof he the said James Alexander doth acknowledge and forever acquit and discharge the said Nicholas Devore Sen. his heirs executors and administrators have granted bargained sold aliened and confirmed and by these presents doth grant bargain & sell alien and confirm unto the said Nicholas Devore senior his heirs and assigns forever all that tract & parcel of land lying and being in the county of Brown and State of Ohio bounded and described as follows to wit. Beginning at a beech corner to Johnston thence North ninety poles to a Popler and two beeches thence East ninety one poles to two poplars and beech thence south ninety poles to a Stake in the end of a lane in said Johnstons line thence with said line west ninety one poles to the beginning containing fifty one acres and thirty poles be the same more or less together with all improvements water courses profits and appurtenances to the said premises belonging or in any wise appertaining and the reversions, remainders and profits and all the estate right title interest property claim and demand of him the said James Alexander of in and to the same. To have and told hold the premises hereby conveyed with all and singular the premises and every part and parcel thereof with every of the appurtenances unto the said Nicholas Devore senior his heirs and assigns forever and the said James Alexander for himself his heirs executors and administrators doth covenant promise and agree to and with the said Nicholas Devore that the premises before mentioned now are and forever hereafter shall remain free from all former and other gifts, grants, bargains, sales, dowers, right and title of dower Judgments, executions, titles troubles Charges and incumbrances whatsoever done or suffered to be done by him the said James Alexander and his heirs will warrant and forever defend the above described lands and tenements? unto the said Nicholas Devore Sen'r and his heirs. The conditions of this mortgage are such that if the said James Alexander shall well and truly pay to Nicholas Devore senior his heirs or assigns one hundred and ten dollars with lawfull interest on or before the first day of June one thousand eight hundred and twenty seven then this obligation to be void? and of none effect otherwise to remain in full force and virtue in ???.
