All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/oh/ohfiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Linda Deppner http://www.genrecords.net/emailregistry/vols/00012.html#0002870 October 7, 2010, 12:31 am Written: January 1, 1828 Recorded: March 22, 1828 Brown County, Ohio Deed Book F6, pages 311-312 Alexander to Masters Whereas Gabriel Alexander at the time of his death was seized and possessed of a certain tract or parcel of land lying and being on the waters of the west fork of Brush creek in the county of Brown and State of Ohio containing two hundred and four acres two quarters and sixteen poles of land and bounded as follows to wit Beginning at a Sugar tree at the corner of a cleared field then south 22 degrees West 155 poles to a gum in the original line then with the same North 67 degrees 12' West 214 poles to two ash and elm trees on the North side of a branch a corner to the original survey then with the line of said survey North 22 degrees East 151 poles to an ash and hickory on the west side of a small branch corner to Thomas Records thence with the said Records line South 68 degrees 16' East 214 poles to the beginning being a part of a survey No. 1043 made for Thomas Blackwell and left John Alexander, Andrew Alexander, Samuel Pilson and Dorcas his wife, William Hollis and Martha his wife, Margaret Alexander, Samuel Masters and Elizabeth his wife, James S. Weems and Eliza his wife his legal heirs and representatives and whereas the said Margaret Alexander for a valuable consideration relinquished her interest in said estate to the other heirs by virtue of which relinquishment each of the other heirs became entitled to the undivided one sixth part and whereas the said John Alexander and wife and said Andrew Alexander and wife have sold their interest in the said land to Samuel Masters and now wish to convey. Therefore This Indenture made this 1st day of January in the year 1828 between the said John Alexander and Jennet his wife of the county of Brown and State of Ohio and the said Andrew Alexander and Agnes his wife of the County of Adams and State of Ohio of the one part and Samuel Masters of the county of Brown and State of Ohio of the other part Witnesseth that the said John Alexander and Jennet his wife and the said Andrew Alexander and Agnes his wife for and in consideration of the sum of one hundred and seventy dollars to each of them in hand paid by the said Samuel Masters the receipt whereof they do hereby acknowledge hath granted bargained and sold aliened enfeoffed and confirmed and by these presents doth grant bargain and sell alien enfeoff and confirm unto the said Samuel Masters his heirs executors and administrators forever a certain tract or parcel of land being the undivided sixth part of the before mentioned tract of land and premises, together with all and Singular the privileges, advantages, and emoluments thereunto belonging or therefrom arising. To have and to hold the estate hereby conveyed to the only proper use benefit and behoof of him the said Samuel Masters his heirs executors and administrators forever and the said John Alexander and Jennet his wife and the said Andrew Alexander and Agness his wife for themselves their heirs executors and administrators do covenant and agree with the said Samuel Masters his heirs Executors and Adm'rs that they have in said land a good estate of inheritance with full and complete power and authority to sell and convey the same in fee simple, that the same is free and clear of all incumbrances whatsoever and that they will warrant and forever defend the title and possession of the same to him the said Samuel Masters his heirs Ex'ors & Adm'rs free and clear of and from the legal claim and demand of all and every person or persons Whatsoever. In testimony whereof the said John Alexander and Jennet his wife and the said Andrew Alexander and Agness his wife hath hereunto set their hands and affixed their seals the date above. John Alexander (Seal) Jennett Alexander (Seal) Andrew Alexander (Seal) Agnes Alexander (Seal) Signed sealed Acknowledged and delivered in presents of Francis Alexander William Alexander Richard Masters The State of Ohio, Brown County, SS This day John Alexander Sr personally came before me a Justice of the peace of said County and acknowledged the signing and sealing and delivering of the within deed to be his act and deed for the purposes therein mentioned, also at the same time came Jennet his wife who being made acquainted with the contents of said conveyance and being by me examined separate and apart from her said husband declared that she signed sealed and as her act and deed delivered the same freely and voluntarily and of her own accord without any coertion or compulsion of her said husband for the purposes therein mentioned. Given under my hand and seal this 10th day of January AD 1828. Francis Alexander, Justice of the peace (Seal) The State of Ohio, Brown County, SS This day Andrew Alexander Snr personally came before me Justice of the peace of said County and acknowledged the signing sealing and delivering of the within deed to be his act and deed for the purposes therein mentioned, also at the same time came Agness his wife who being made acquainted with the contents of said conveyance and being by me examined separate and apart from her said husband declared that she signed sealed and as her act and deed delivered the same freely voluntarily and of her own accord without any coertion or compulsion of her said husband for the purposes therein mentioned.
