George P. Tyler Sole? Judge of the Probate Court in and for said County on the 21st day of July A.D. 1884 No. 703 Andrew Alexander - Will Brown County S.S. Be it Remembered that heretofore to wit on the 11th day of July A.D. 1884, an application was filed here in the words and figures following to wit: "In the Probate Court Brown County, Ohio In the matter of the Will of Andrew Alexander deceased To the Honorable the Judge of said Court And now Comes Jasper Hindman & Charles Alexander and produces for Admission to Probate in said Court the last Will and Testament of Andrew Alexander late a resident of the Township of Eagle in said County, who died on the 27th day of June 1884. Said Testator died leaving no widow and the following named persons all of his next of Kin resident in the State of Ohio. Name Degree of Kinship P. O. Address Margaret E. Alexander being first duly sworn says the statements of the foregoing application are true as he verily believes. C. T. Alexander Sworn to before me and subscribed in my presence this 11th day of July A.D. 1884. George P. Tyler Probate Judge And on the same day an entry was made in the Journal of said Court in the words and figures following to wit: "Andrew Alexander Will This day was produced and filed here a paper writing purporting to be the last Will and Testament of Andrew Alexander late of Eagle Township Brown County Ohio, deceased and at the same time application filed to Probate the same. Ordered by the Court that due and legal notice be given of the fileing and time of hearing the same to all the next of Kin residents of the State of Ohio which time of hearing is fixed for July 21, 1884 at 10 o'clock A.M. And thereupon a notice to heirs issued in the words and figures following to wit: "The State of Ohio) Brown County S.S.) In Probate Court In the matter of the last Will and Testament of Andrew Alexander deceased. To Margaret E. Wilson, Rose Alexander, Hannah E. Hindman, Charles T. Alexander, James Alexander and Hannah Tomb. You are hereby notified that on the 21st day of July A.D. 1884, an instrument of writing purporting to be the last Will and Testament of Andrew Alexander late of Eagle Township in said County deceased was produced in open Court and an application to admit the same to Probate was on the same day made in said Court. Said application will be for hearing before this Court on the 21st day of July A.D. 1884 at 10 o'clock A.M. (L.S.) George P. Tyler, Probate Judge Dated at Georgetown Ohio this 11 day of July A.D. 1884. Said notice was duly returned in words as follows to wit: "We the undersigned persons within named hereby acknowledge service of the within notice, this 12th day of July A.D. 1884. James Alexander C. T. Alexander Rose Alexander Margaret E. Wilson Hannah E. Hindman And afterwards on the 21st day of July A.D. 1884, the following Journal entry was made herein to wit: "Andrew Alexander Will, This day this matter came on further to be heard upon the application heretofore filed here to Probate a paper writing purporting to be the last Will and Testament of Andrew Alexander late of Eagle Township Brown County deceased. And the Court being satisfied that due and legal notice has been given to all the next of Kin of the filing and time for hearing the same. Thereupon appeared in open Court John Thompson and William Parish the subscribing witnesses to said Will and Testament of said Andrew Alexander late of Eagle Township Brown County Ohio deceased who being duly sworn according to Law to speak the truth the whole truth and nothing but the truth in relation to the execution of said will depose and say That the paper before them bearing date the 18th day of October A.D. 1881 purporting to be the last Will and Testament of Andrew Alexander now deceased is the will of said deceased, that they were present at the execution of said Will and at the request of the Testator respectively subscribed their names to the same as witnesses in his presence, that they saw the said Andrew Alexander when in full life but who is now deceased Sign and Seal said Will and heard him acknowledge the same to be his last Will and Testament and that the said Andrew Alexander at the time of making signing and Sealing said Will was of full age of sound mind and memory and not under any restraint. Ordered by the Court that said last Will and Testament be now admitted to Probate, that it together with the proof thereof be recorded as the valid last Will and Testament of Andrew Alexander deceased. Which said Will is in the words and figures following to wit: Will "In the name of the Benevolent Father of all I Andrew Alexander of Brown County Ohio do make and publish this my last Will and Testament. Item 1st. I devise and bequeath to my son James Alexander the one fifth part of the farm that I now reside on situated in Eagle Township Brown County Ohio. Item 2nd. I devise and bequeath to my three grand-daughters (to wit) Margaret E. Wilson, Hannah E. Hindman and Nancy R. Alexander and my grand-son Charles T. Alexander the four fifths of the above described farm. Item 3rd. I devise and bequeath to my grand-son Charles Alexander the Bed Stead bed and bed clothing that my daughter-in-law Helena Alexander give me. Item 4th. I devise and bequeath to my son James Alexander and my three grand- daughters Margaret E. Wilson, Hannah E. Hindman, Nancy R. Alexander and my Grand-son Charles Alexander all my personal property (except that devised in item 3rd) after all my debts are paid to be divided equally between them. Item 5th. I do hereby nominate and appoint Jasper Hindman and Charles Alexander Executors of this my last Will and Testament hereby authorizing and empowering them to compromise adjust release and discharge in such manner as they may deem proper the debts and claims due me. I do also authorize and empower them if it shall become necessary in order to pay my debts to sell by private sale or in such manner upon such terms of credit or otherwise as they may think proper, all or any part of my real estate and deeds to purchasers to execute acknowledge and deliver in fee simple. I desire that no appraisement and no sale of my personal property be made and that the Court of Probate direct the omission of the same in pursuance of the Statute. I do hereby revoke all former Wills by me made. In testimony hereof I have hereunto set my hand and Seal this 18th day of October in the year A.D. 1881.
