H. Stevenson Probate Judge in and for said County of the 13th day of September A.D. 1875. 436 William Alexander Will Be it remembered that on this day to wit: on the 13th day of September A.D. 1875 the following entry was made in this case to wit: Entry This day was produced to the Court a paper writing purporting to be the last will and testament of William Alexander deceased, late of Brown County Ohio, and also personally appeared in open Court Wm. Bell and S. L. Swain the attesting witness thereto who after being duly sworn according to law testified to the due execution thereof and their testimony was reduced to writing and by them Subscribed and filed and the Court having heard all the testimony and being fully advised on the premises finds that said paper writing is the last will and testament of Wm. Alexander deceased. That the same was recorded in conformity with the laws of the State of Ohio in force at the time. That at the time of the execution thereof said testator was of legal age, of sound and disposing mind and memory, and not under any restraint whatever. Will Which said will is in the words and figures following to wit: William Alexander's Will In the name of the benevolent Father of all I, William Alexander, of the County of Brown, State of Ohio, do make and publish this my last will and testament. Item first, I devise and bequeath to my daughter Hannah L. Alexander (60) Sixty acres of land to be surveyed off from the North end of the following described farm running full length East and West, being a part of the farm on which I now reside, Situated on the Road leading from Hillsboro to Ripley in the State of Ohio and County of Brown. Item Second, I devise and bequeath to my daughter Mary L. Alexander (45) Forty five acres of land being a part of the above described farm. Item Third, I devise and bequeath to my daughter Augusta M. Alexander (45) Forty five acres of land being a part of the above described farm. Item Fouth [sic], I also devise and bequeath to my three above named daughters each to have one cow and an equal share of my household and kitchen furniture. Also if in case the farm situated and described as aforesaid should be resurveyed or divided among the above named daughters it should be found that it contains more land than the deed calls for, that the excess shall be given to my daughters Mary L., Hannah L. and Augusta M. equally. Item Fifth, I devise and bequeath to my daughter Surilda J. Bains [see note below] and her heirs forever (40) Forty acres of land Situated in the State of Ohio County of Brown and known as the old Alexander farm, said tract shall be surveyed from the West end of the above described farm and comprising a tract of the full length North and South of said farm. Item Sixth, I devise and bequeath to my daughter Elizabeth S. Grayham (40) Forty acres of land adjoining my daughter Surilda, on the East being a part of the above described farm. Item Seventh, I devise and bequeath to my daughter Sarah A. Sayres and her heirs forever (40) Forty Acres of land adjoining my daughter Elizabeth S. on the East, being a part of the above described farm. Item Eighth, I devise and bequeath to my daughter Susan C. Sanders and her heirs forever 42 Forty Two acres of land adjoining my daughter Sarah A. on the East being a part of the above described farm. Item Ninth, I devise and bequeath that in case the above described farm should be resurveyed or divided and it should be found that it contains more land than the deed calls for, that the excess shall be equally divided between my daughters Surilda J., Elizabeth S., Sarah A. and Susan C. respectively. Item Tenth, I devise and bequeath to my son Joshua P. Alexander the sum of $300.00 Three Hundred dollars. Item Eleventh, I do hereby appoint Joshua P. Alexander and William Burns Executors of this my last will and testament and that they shall not be required to give bond and security in this case. I do hereby revoke all former wills by me made. In testimony whereof I hereunto set my hand and seal this 10th day of August A.D. in the year of our Lord 1875. Wm. Swain And the testimony of William Bell and S. L. Swain is in the words and figures following to wit: Testimony of Wm. Bell & S. L. Swain Probate Court Brown County Ohio. In the matter of admitting to Probate the paper writing purporting to be the last will and testament of William Alexander late of Brown County Ohio deceased, William Bell and S. L. Swain attesting witnesses to said paper writing being duly sworn deposeth and saith that they each saw said testator Wm. Alexander sign and subscribe said paper writing at the end thereof and as his last will and testament and at the time of signing of said paper writing said testator was over the age of twenty one years and he was of sound mind and memory and not under any restraint and that they each subscribed their names as witnesses to said paper writing in the presence of said testator and at his request.
