P. Berlin Probate Judge in and for said County on the 8th day of April A.D. 1880 570 Helena Alexander Will Be it remembered that heretofore to wit on the 6th day of April A.D. 1880 the following entry was made in this case. Entry This day was produced and filed here a paperwriting purporting to be the last will and testament of Helena Alexander deceased, late of Brown County Ohio and at the same time application made to admit the same to probate, it is therefore ordered by the Court that all the legatees and next of kin of the decedent has legal notice of the filing and time for hearing said application which time is fixed by the Court for Wednesday April 7th 1880 at 10 o'clock A.M. Which application is in the words and figures following to wit: Application To the Honorable the Judge of said Court And now comes J. W. Winters and produces for admission to probate in said Court the last will and testament of Helena Alexander late a resident of the township of Eagle in said county who died on the 30th day of March A.D. 1880, said will was not deposited during the lifetime of the Testator in the office of the Judge of the Probate Court of said County for safekeeping as allowed by law, said Testator died having no children or husband but the following persons all of her next of kin resident in the State of Ohio. Winters State of Ohio Brown County S.S. The above named J. W. Winters having first duly sworn says the statements of the foregoing application are true as he verily believes. Sworn to before me and subscribed in my presence this 6th day of April A.D. 1880. J. P. Berlin, Judge Notice State of Ohio Brown County S.S. To Andrew Alexander & Clara B. Ling You are hereby notified that on the 6th day of April A.D. 1880 an instrument of writing purporting to be the last will and testament of Helena Alexander late of Eagle Township in said County deceased was produced in open Court and an application to admit the same to probate was on the same day made in said Court, said application will be for hearing before this Court on the 7th day of April A.D. 1880 at 10 o'clock A.M. J. P. Berlin, Judge Dated at Georgetown Ohio this 6th day of April 1880. We the undersigned persons within named hereby acknowledge service of the within notice this 6th day of April A.D. 1880. Andrew Alexander Clara B. Ling And on the 7th day of April A.D. 1880 the following entry was made. Entry This day this matter came on for hearing on the application heretofore filed here, and the Court being satisfied that all the next of kin to the decedent resident of the State of Ohio have been duly and legally notified on the filing of said application and time for hearing the same, and at the same time came into open Court John C. Breckenridge and E. S. Sanders the subscribing witnesses to said will who after being duly sworn according to law testified to the due execution of the same and their testimony was reduced to writing and by them subscribed and filed, and the Court having heard all the evidence and arguments of counsel and being fully advised in the premises finds that said paper writing is the will of said Helena Alexander now deceased, that it was executed according to the laws of the State of Ohio in force at the time, that at the time thereof the Testatrix was of legal age of sound and disposing mind and memory and under no undue or unlawful restraint whatever, it is ordered by the Court that said will the testimony of the witnesses and the orders and findings of the Court together with the proceedings herein be recorded. Which will is in the words and figures following to wit: Will I, Helena Alexander of Fincastle Brown County Ohio do make and publish my last will and testament. Item 1st: I want all my personal property sold, my household and kitchen furniture wood and bees [?]. Item 2nd: I want a monument for all three of our graves, mine and John's and Andrew's, for six hundred dollars. I want Andrew Alexander to have one bed and bedding providing he is living, and if he is dead, sell them the same as my other property. I want my burial expenses all paid and my Doctor bills all paid and my board bills all paid and I want M. B. Ruebush to have my watch. I give and bequeath to Clara B. Ling twenty five dollars. Item 3rd: I want all my money that's left it there is any to be equally divided between my sister and Andrew Alexander. I want William Winters Executor of my will. In testimony hereof I have hereunto set my hand and seal this 28th day of January A.D. 1883. Sanders Testimony State of Ohio Brown County S.S. Personally appeared in open Court John C. Breckenridge and E. S. Sanders the subscribing witnesses to a paper writing purporting to be the last will and testament of Helena Alexander deceased who being duly sworn according to law to speak the truth the whole truth and nothing but the truth in relation to the execution of said paper writing depose and say that the paper before them purporting to be the last will and testament of Helena Alexander now deceased is the will of said deceased, that they were present at the execution of said will at the request of the Testatrix subscribed their names to the same as witnesses in her presence and that they saw the said Helena Alexander deceased sign and seal said will and heard her acknowledge the same to be her last will and testament, and the said Helena Alexander at the time of making signing and sealing said will was of legal age and of sound and disposing mind and memory and under no undue or unlawful restraint whatsoever.
