RECORD OF WILLS, BROWN COUNTY, OHIO Samuel Ashton Will Pleas held at the Courthouse in Georgetown, Brown County Ohio before the Honorable John W. Price President Judge of the tenth judicial circuit of the State of Ohio David Johnson and Hugh B. Payne Esquire associate Judges of the Court of Common Pleas of the County of Brown on the thirty first day of March in the year one thousand eight hundred and thirty four Brown County~ This day the last will and testament of Samuel Ashton deceased was produced in open Court by Gideon Dunham the Executor therein named and sworn by the oath of Job Curless and Eliza Curless subscribing witnesses thereto and ordered to be recorded together with the proof, therefore certificate is granted to the said Gideon Dunham for having obtained probate of said will in due form of law, which said will is in the words following, to wit "I, Samuel Ashton Sr, of the County of Brown and State of Ohio do make and publish this my last will and testament in manner and form following, that is to say first: it is my will that my funeral expenses and all my just debts be paid fully, second, I give, devise and bequeath to my beloved wife Sarah Ashton the plantation on which we now reside, situate in the County aforesaid, containing about twenty five acres, during her natural life and all the livestock horses cattle sheep hogs etc by me now owned, also all the household furniture and other items not particularly named during her natural life aforesaid and at the death of my wife all the property hereby devised or bequeathed to her as aforesaid in so much as thereof may remain unexhausted to be equally divided between my daughter Hannah Ashton and my wife's daughter Rhoda Curless and to their heirs and assigns forever and lastly I hereby constitute and appoint Gideon Dunham to be Executor of this my last will and testament revoking and anulling all former wills by me made and ratifying this and no other to be my last will and testament. In testimony whereof I have hereunto set my hand and seal this 31st day of December in the year of our Lord one thousand eight hundred and thirty three. Samuel Ashton Sr Signed, published and declared by the above named Samuel Ashton as and for his last will and testament in presence of us who at his request have signed as witnesses to the same Job Curless Eliza Curless Brown County Common Pleas March term A.D. 1834 Personally came into open Court here Job Curless and Eliza Curless who being duly sworn depose and say that they are subscribing witnesses to the instrument of writing here produced purporting to be the last will and testament of Samuel Ashton deceased that they signed the same as witnesses at the request of the testator who acknowledged the same to be his last will and testament that he was of sound mind and memory and under no restraint and more than twenty one years of age at the time of signing and acknowledging the same. King Clerk --------------------------------------------------------------------- Just a bit of clarification on there being two versions of Samuel Ashton Sr's will: For some reason the will was entered in the will book twice by the clerk; the two versions read exactly the same, but the handwriting is different. I have photocopies of both versions or entries. The one I've mentioned on pages 235-236 of Will Book 1 is the easiest to read. The other entry was on pages 246-248, and the handwriting is much smaller and almost "spidery". I hope this may clear up any confusion that might arise from a mention of two versions of this will.
