It being the sixty seventh year of the Independance of the United States and of the state of Ohio the forty first. This day the last will and testaments of James Rounds Sr. late of Brown county Decd-was produced in open court and proved by the oaths of Isaac Dean and Ephraim Gavison, subscribing witnesses thereto which will together with the proof was ordered to be recorded. The will is in the words & figures following to sit "In the name of God Amen, I James Rounds Sen. of Clark township Brown county State of Ohio, being this 21st day of December AD 1836 sound in memory and reason blessed be God for his mercies, do make this my last will and testament in form and manner following that is to say First I commit my body to the Grave in a decent and christian like manner & my soul to God who gave it. Secondly I give to my beloved wife Elizabeth one good bed and bedding and all her wearing apparel, and all my wool, flax, thread, yarn and (unreadable) manufactured; and her womans saddle, one wheel, one reel, one table, two chairs, one pot, one stew kettle, one oven, one skillet & lid. All my cupboard ware, and the privilege of the house and premises & sufficient to support until such time as the real estate can be sold. And thirdly that all the remainder of my estate both real and personal to be sold, and all my debts collected; then my funeral expenses, Doctors bill and then all my Just debts to be paid, before any division is made of the said estate. Fourthly I give to my beloved wife Elizabeth one third part of the whole amount of what remains; and the other two thirds to be divided equally among my heirs - namely - Abigail Boothby, Sarah Leonard, James Rounds, Rachel Lovenquire, Mary Palmer, and the heirs of Eunice Dawson decd - to draw one equal share to be divided among the said heirs of the said Eunice Dawson. And Sixthly that all the notes accounts and receipts standing against any of the said heirs shall be allowed out of their share. I appoint my beloved wife Elizabeth, my son James Rounds and Robert Kennady Esq my lawful executors of this my last will and testament - and I hereby revoke and make void all former wills by me made - in witness whereof I have hereunto set my hand and seal the day and year above written. Signed sealed published by the above named James Rounds, to be his last will and testament, in the presence of us, who have hereto subscribed our names as witnesses in the presence of the Testator. This day came into open court Isaac Dean and Ephraim Garrison subscribing witnesses to the last Will and Testament of James Rounds Sen. deceased, and being duly sworn according to law say that the paper writing here produced and signed by the said James Rounds as his last Will and Testament in their presence, that he was of sound & disposing mind memory & Judgement, at the time, over twenty one years of age & under no restraint whatever; and that they signed said Will as Subscribing Witnesses thereto, in the presence of the said James Rounds, and at his request. (Signed) Isaac Dean - Ephraim Garrison - Sworn to and subscribed in open court this twenty first day of January AD 1843 By David Johnson Seignior Associate Judge of said court. And it is ordered that letters testamentary issue to Robt Kennady & James Rounds Jr the executors named in said Will, thereupon came into open court the said Robert Kennady & James Rounds Jr together with Hugh Kennady & Michael Kennady their securities, and entered into bond in the penal sum of twenty four hundred dollars, conditioned as the law requires; which bond and securities were approved by the court Ordered that William Neal Nicholas Mather and (unreadable) F.
