Butler Co., OH, Deed Book G, p. 192 I George Debolt one of the sons and heirs at Law of Henry Debolt late of the County of Butler in the State of Ohio deceased. To all to whom these presents shall come send greeting. Whereas the said Henry Debolt at the time of his death stood seized of in and to section seventeen of Township two in Range four East of the meridian line drawn from the mouth of the great Miami River lying and being in the County of Butler the State of Ohio and whereas the said Henry Debolt in his life time to wit on the sixteenth day of December in the year of our Lord one thousand eight hundred and five in the County aforesaid did enter into articles of agreement to sell unto Obediah Webb or with Joseph Brown for the said Obediah Webb forty two acres and eighty five square poles of land out of the aforesaid section of land to wit Beginning at the Southeast corner of the said Seventeenth section thence Running west one hundred and fifty eight poles and twenty one links to the southeast corner of John Single' [or Lingle] twenty five acre tract in said section. Thence North fifty poles to a stake thence East one hundred and two poles to a stake. Thence South twenty poles to a stake, thence East fifty six poles and twenty one links to a dogwood corner on the section line. Thence South along the said line thirty poles to the place of Beginning and to make or cause to be made unto the said Obadiah Webb a good and sufficient Deed for the same land, provided the said Obediah Webb would well and truly pay unto the said Henry Debolt his heirs Executors administrators or assigns the sum of one hundred and twenty seven dollars and fifty nine cents for the same, and although the said one hundred and twenty seven dollars and fifty nine cents the purchase money aforesaid for the said lot or tract of land has been fully paid as aforesaid by the said Obediah Webb, to wit thirteen dollars part thereof unto the said Henry Debolt in his lifetime, and the remainder together with the Interest thereof unto May Boles, late May Debolt, and Michael Debolt adminsitrators of all and singular the goods chattels and entity of which were of the said Henry Debolt dec'd for before the completion of the said Sale or Contract on the part of and behalf of the said Henry Debolt according to the terms and stipulations of the said Contract to wit on the twenty seventh day of December in the year of our Lord one thousand eight hundred and five at the County of Butler aforesaid the said Henry Debolt died leaving heirs under the age of twenty one years and whereas May Boles late May Debolt and Michael Debolt adminsitrators of the estate of the said Henry Debolt being desirous that what was just and right in the said premises should be done did according to the provisions contained in the act providing for the execution of Real contracts in certain cases ad??t?? and make known to the Court of Common Pleas of Butler aforesaid holden at Hamilton in the said County of Butler on the second day of April Eighteen hundred and Sixteen all and singular the premises aforesaid by their petition in due form of law exhibited where for all and singular the premises being ??? and by the said Court fully understood and it being fully and clearly proven and made to appear to the Satisfaction of the said Court that the said contract or sale aforesaid had been duly entered into and made by the said Henry Debolt in his life time and the said Obediah Webb, or by Joseph Brown for the said Obediah Webb and that the said contract had been fully complied with on the part and behalf of the said Obediah Webb and also that the said Obediah Webb has full right to demand and secure a conveyance of the said lot of land aforesaid. Therefore it was ordered by the said Court that George Debolt, one of the sons and heirs at Law of the said Henry Debolt deceased should be and he the said George Debolt was thereby appointed ????? and empowered fully to complete the said Contract aforesaid by the said Henry Debolt in his life ??????? aforesaid and to make and execute a deed of conveyance for and on behalf of the heirs of the said Henry Debolt, deceased to the said Obediah Webb his heirs and assigns according to the ??? and form of the Statute in such case and ???? all of which refference being had to the Records of the said Court of the Count of Butler of the Term of April Eighteen hundred and Sixteen will amongst other things more fully appear. Wherefore now know ye that I the said George Debolt one of the sons and heirs at Law of the said Henry Debolt deceased aforesaid in the execution of the power and trust in me assigned aforesaid in consideration of the aforesaid sum of one hundred and twenty seven dollars and fifty nine cents the purchase money aforesaid having been fully paid by the said Obediah Webb and by the said Joseph Brown for the said Obediah Webb part thereof to the said Henry Debolt in his life time and part thereof unto May Boles late May Debolt and Michael Debolt adminstrators of the estate of the said Henry Debolt since his decease by these presents have and do hereby grant bargain sell alien enfeoff release convey and confirm unto the said Obediah Webb his heirs and assigns forever all and singular the aforesaid lot of land to wit it being part of section seventeen of Township Two in Range four East of the meridian line Beginning at the Southwest Corner of the said section thence West one hundred and fifty eight poles and twenty one links to a stake, thence North fifty poles to a Stake, thence East one hundred and two poles to a stake thence South twenty poles to a Stake then East fifty six poles and twenty one links to a dogwood corner on the east boundry line of the section, thence South on the said line thirty poles to the place of Beginning containing forty two acres and wighty five square poles of land with all the privileges and appurtenances to the same belonging or in any wise appertaining. To have and to hold all and singular the above granted and bargained premises and appurtenances to the said Obediah Webb his heirs and assigns To the only proper use benefit and behoof of the said Obediah Webb his heirs and assigns forever in as full and complete and ample a manner as I the said George Debolt one of the sons and heirs at Law of the said Henry Debolt deceased by virtue of the authority aforesaid might could or ought to convey the same.
