DEED:  William McCann and Elizabeth to Samuel Walters

28 Jan 1858 Clermont, OH Vol 75 p 30

Know all men by these presents that we William McCann and Elizabeth McCann wife 
of the said Wm McCann of the County of Clinton, Ohio in consideration of the 
sum of one hundred dollars in hand paid by Samuel Walters of the County 
Clermont (sic) in the state of Ohio aforesaid  have bargained and sold and do 
hereby grant Bargain Sell and Convey unto the said Samuel Walters his heirs and 
assigns forever the following premises Situate lying and being in the County of 
Clermont in Union Township and in the State of Ohio being a part of Survey No 
2745 and bounded and described as following (to wit) Beginning at a stone in 
the line of Joseph Davis and corner to Isaac Edwards, thence with said Edwards 
line S 8 degrees 2 minutes West 20 poles to a stone in the line of said Edwards 
Hence North 80 degrees 58 minutes W 34 poles to a stone in the line of said 
Joseph Davis hence with said Davis line N 661/2 E 40 degrees 10 poles to the 
place of beginning containing two  (21 acres and twenty poles be the same more 
or less. To have and to hold said premises with the appurtenances unto the said 
Samuel Walters his heirs and assigns forever and the said Wm McCann for himself 
and his heirs doth hereby Covenant with the said Samuel Walters his heirs and 
assigns that he is lawfully seized of the premises aforesaid that the premises 
are free and clear from all incumbrances whatsoever and that he will forever 
warrant and Defend the same with the appurtenances unto the said Samuel Walters 
his heirs and assigns against the lawful claims of all persons whomsoever.

In Testimony Whereof the said Wm McCann and Elizabeth McCann have hereunto set 
their hands and seals this Twenty third day of January in the year of our Lord 
one thousand Eight hundred and fifty eight .

The State of Ohio Highland County.

Before me N M Cummins a Justice of the peace in and for said County personally 
appeared the within and above named Wm McCann and Elizabeth his wife and 
acknowledged the signing and sealing of the within and above conveyance to be 
their voluntary act and deed. And the  said Elizabeth being at the same time 
examined by me separate and apart from her said husband and the Contents of 
said Deed, instrument, being made  known to her by me, She then declared that 
she did voluntarily sign seal and acknowledge the same and that she is still 
satisfied therewith.  This 25th day of January A.D. 1858.  N M Cummins JP
