All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/oh/ohfiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Mary Buehler buehler2149@yahoo.com June 25, 2018, 6:34 pm Source: Ohio, Wills And Probate Records,1786-1998,clermont, Wills, Vol F-g Written: January 1, 1847 Recorded: March 23, 1853 Pg 142 Proceedings held before George Lee Judge of the Probate Court in and for the County of Clermont and State of Ohio at the Probate Court held in Batavia in said County On the 23rd day of May A.D. 1853 Be it remembered that this day the last Will and testament of Abel Donham deceased was produced in open court and proven by the oaths of Cyrus Rayford and George Sapp two of the subscribing witnesses ______ and the Court being satisfied that said Will was duly executed published and attested that said testator was at the time of executing and publishing said will of sound mind and memory over twenty one years of age and free from all restraints do order that said will be established and that said will and the proof is reduced to writing be recorded and thereupon on motion to the Court by Enoch Tracy and Solomon Fitzpatrick the executors for said will _____ it is ordered that Letters Testament are issued to them and thereupon came said Enoch Tracy and Solomon Fitzpatrick and gave bond and surety to the acceptance of the Court conditions according to law and the court appoints W.B. Nichols A.O. Fagin & Silas Dolan appraisers of the personal estate. ______ G.S. Lee PJ Will to Wit: In the name of God, Amen, I Abel Donham (page 143) of Clermont county and State of Ohio being in perfect health of body and of sound and disposing mind and memory and understanding considering the certainty of death and the uncertainty of the time thereof and being desirous to settle my worldy affairs and thereby be the better prepared to leave the world when it shall please God to call me home do therefore make and publish this my last will and testament in manner and form following that is to say First and principally I commend my soul to God and my body to the earth to be decently interred then I devise and bequeath as follows First I give and bequeath unto Elizabeth Donham my wife all my real and personal estate during her natural life and when my wife Elizabeth ceases to be then all my property & estate real and personal to be sold & divided as follows I give and bequeath unto my daughter Pennina Butler one hundred dollars. 2nd I give and bequeath unto my Daughter Elvira Vanader two hundred and fifty dollars 3rd I give and bequeath unto my Daughter Juliann Whidden three hundred dollars 4th All the ballance to be equally divided among the rest of my children that is to say all the residue of my estate namely John Donhan my son Louis Donham my son Abel Donham my son and my Daughters Sarah Fitzpatric Mary Bothyman Elizabeth Tracy Cynthia Ferguson High__ssa Randall Nancy Cole and Evalene Chapman and lastly I do hereby constitute and appoint Enoch Tracy and (page 144) Solomon Fitzpatrick my sons in law to be sole executors of this my last Will and testament. In testimony whereof I have hereunto set my hand and seal this first day of January in the year of our Lord one thousand eight hundred and forty seven Signed Abel Donham (Seal) Signed dated and declared by Abel Donham the above named testator as and for his last will and testament in the presence of us who at his request and in his presence have subscribed our names unto as witnesses. Signed George Sapp Cyrus P. Rayford Proof of Will to Wit The State of Ohio ) Clermont County ) SS Personally appeared in open Court George Sapp and C. P. Rayford subscribing witnesses to the paper purporting to be the last will and testament of Abel Donham deceased and being duly sworn according to lay depose and say that they were each called upon to sign said paper as witnesses by the said Abel Donham decd and that they each in his presence and at his request signed the same as witnesses and that said Abel Donham _______ then and there declared the same was his last will and testament and that he executed the same as such that at the time of executing and publishing the same said Abel Donham was over the age of twenty one years of sound mind and memory and (page 145) not under any restraint.
