Public Library Written: April 18, 1855 Recorded: June 20, 1855 Will of Joseph Fagin I, Joseph Fagin of the County of Clermont and State of Ohio, considering the uncertainty of life and being of sound and disposing mind and memory and being desirous of settling my worldly affairs while I have strength and capacity so to do, do make and publish this my last Will and Testament, that is to say, 1st I will and wish that after my decease my executor or administrator shall proceed to sell off all my property (both real estate and personal property, of which I may die seized) to the best advantage. 2nd I give and bequeath to my son Joseph B. Fagin the sum of one thousand dollars to be given to him out of the first moneys that may come into the executors’ hands, after paying off my past debts, for which the said Joseph is to live with me and take good care of me during my natural life. 3rd To my son James Fagin I give and bequeath five dollars, I having already given him a large amount of property. 4th To my son Aaron W. Fagin I give and bequeath five dollars, I already having given him a large amount of property. 5th To my Grand Daughter, Rachel Ann Carter (?), (formerly Fagin), I give and bequeath one dollar. 6th To my Grand Son Charles S. Fagin, I give and bequeath one dollar. 7th To my Grand Son Robert Davis (son of my daughter Mary), I give and bequeath the sum of one dollar. 8th To my Grand Son Enos J. Seals, (son of my daughter Mary), I give and bequeath the sum of one dollar, the ancestors of the above grandchildren having already received a large amount of property from me. 9th I also direct that the net proceeds of my property both real and personal herein before ordered by me to be disposed of be equally divided share and share alike soon as is can be done with my sons Lewis Fagin, and Joseph B. Fagin and my daughter Malinda Lindsey to the amount of six thousand dollars, that is to say two thousand dollars apiece, besides the one thousand before given to Joseph; and lastly - should there be more property or money left after paying all of my past debts and expenses, and also paying off the legacies herein before mentioned, I then give and bequeath all the rest and residue of my property to my sons Lewis Fagin, Andrew J. Fagin, Joseph B. Fagin, and my daughter Malinda Lindsey to be divided among them equally share and share alike, Andrew J. Fagin having already received from me a tract or piece of land considered by me worth the sum of two thousand dollars. And should Lewis Fagin, Andrew J. Fagin, Joseph B. Fagin or Malinda Lindsey or either of them die before I do without leaving legal heirs, then I give and bequeath their said share to the said survivors to be divided share and share alike among them. And I hereby appoint Lewis Fagin sole executor of this my last will and testament, hereby revoking all former wills by me made. In witness whereof, I hereinto set my hand and seal, at Clermont County aforesaid this 10th day of April eighteen hundred and fifty five.
