Court of Common Pleas (Special) began and held at the Court house in the Town of Coshocton, Coshocton County Ohio, on the 16th day of February A. D. 1848. Beit Remembered that on this day & year last afforesaid The last Will & Testamont of David Groves, Deceasted late of Coshocton County was this day produced in Writhing by Thomas McBride & Richard Moode criedible Witneses thereunto being in Open Court duly Sworn & Severally Examined & Whose testimony was taken in writing and Signed & duly filed & it appearing to the Court from the above testimony of Said Witnesses that the Said las Will & Testament was duly executed that the testator at the time of Executing the same was of full age, of Sound mind & Memory & not under any restraint. It is by the Court ORdered that the said last Will & Testament, together with the proof ther of be recorded by the Clerk of this Court & that letters Testamentary, with a Copy of the Said Will annexed be issued to John Grove and or Richard Moode the executors Named therein. Whereupon Siad RIchard Moode & John Groves appeared in Open Court & acepted Said appointment. Thereupon it was by the Court Ordered that they give bond in the Sum of Sixteen hundred dollars conditioned as the law directs. Heny Hains & James Copelen are accepted as Surities & Thomas Treadaway Henny Hains & Nathan Wright are appointed to appraise the property of Said Estate ----- Will In the Name of the benevolent Father of all I David Grove of Jefferson Township Coshocton County & State of Ohio, on make & publish this my last Will & Testament... Item 1st I give & devise to my beloved Wife in Liew of hr dower the farm on Which we no reside. Situate in Jefferson Township Coshocton County Ohio be the same more or less during her natural life as follows towit She to retain possession of the Same until My youngest Son arrives at the full age of Twenty one years. At which period I wish my two youngest Sons to have the said peace in possession Eccept so much of the dwelling House as she may need & the acre of Garden Spring Spring House firewood, pasture & that she ay need for her own during her natural life & my said two Sons to pay her a yearly & every year the one fourth part of all produce raised on the said place, wheat delivered in the bushell where she may direct. corn. Oats. buckwheat, rye & C when ready for market where She may direct not at a grater distance than Roscoe. Hay in the Stack Where she may direct on the said farm...& also the Household & kitchen furniture now beloning to said House & Kitchen Cook Stove & corow in use during her natural life Except so much as may be disposed of in this Will. Should any of the property left to my said Wife be uncomsumed at her death I wish it disposed of by my Executors & the proceeds Equally divided among my Children |I.E.| Share & Share alike. Item 2nd It is my Will that my said Wife and Children unmarried continued together on the farm above named until they respectively arrive at full age or until they may respectively..... Item 3rd I give & devise to my Daughter Melissa, one hundred and forty dollars to be levied out of my Estate she having received one hundred and Sisty dollars. & receipted for the same (making together three hundred dollares) She is not ot receive any more until her sister herinafter named Shall receive a like amount & then to receive a rateable proportion with the Others as hereafter directed Item 4th I give & devise to my Daughter Elizabeth one Chest one pair of Bedsteds one double coverlid five Blanketts, one Bedtick & fetahers & ballance of Bedding. & one side Saddle being the property She now claims the Whole valued at Seventy Six dollars, and also Two hundred and twenty four dollars in cash to pe paid as follows. Eighty four dollars to be paid out of the proceeds of my personal Estate out the the first monies ccollected. The ballance no to be paid untill the rest of my daughters receive So much as to make them Equal with her. then to receive her ratable proportion with the rest as hereafter directed. Item 5th I give & devise to my daughter Nancy, one chest one pair bedsted, one double coverlid five twilled Blanketts one Bedtick & feathers & balance of bedding and one saddle being the same She now claims valued at Seventy Six dollars & also Two hundred & twenty dollars in cash to be paid as follows Eighty four dollars to be paid out of the proceeds of my personal Estate, the ballance not to be paod until the rest of my Daughters is made Equal then to Receive a ratable proportion With the rest of my Daughters as hereafter dircted. Item 6th I give & devise to my Daughters Susannah, Mary, Sarah Jane & Eliza Three hundred dollars eact to be paid as follows one hundred & sixty dollars out of my personal Etate to each to be put at Interest for ther use until they are are full age the Balance to be paid ratably as hereafter directred provided there shuold not be a sufficiency to pay the first Installment to Eacho of my Daughters they are to have aratable proportion of the mony's arrising from the Personal Property Item 7th I give & devise to my son John the Farm known by the Name of the Shaw Place in Jefferson Township afforesaid by his paying his Equal Share with his Brother Jacob hereafter named to make up any deficiency of the legacies bequeathed to my Daughters after appropriateing the avoils of the personal property & rents & proffits of the Shaw Place & the rents proffits of the Clark Place as hereafter named, which I wish my Executors to rent untill my son John, arrives at full age & apply the preceeds to the payment of my Daughters at which time my son John to take Possession & pay his proportion of the deficienciyes as hereafter provided Item 8th I give & devise to my son Jacob the Clark place so called in Jefferson Township afforesaid by his paying his Equal part of any deficeincy to make up the Legacies bequeathed to my Daughters as stated in afformentioned Item, of the bequest to my son John the said farm to be rented by my executors until my son Jacob Shall arrive at the age of twenty one years & the proceeds to be applied to the payment of my afforesaid Daughters. Item 9th I give & devise to my two sons Dave & WIlliam Hanger the Place we no live on Share & Share alike to be by them Received when my son William Hanger arrives at the age of twenty one years, as stated in the devise to my Wife Provided my Said Wife Should die Previous to the time my youngest Son William Hanger arrives at the age of twenty one years. I then require that my sons Dave & William Hanger pay their Equeal proportion of one third of any deviciency in Making up the Bequest to my said Dughters. Item 10th I will & devise that my sons aforesaid named paytheir respective shares of the defiecienys afforesaid,, for the use of my Daughters in Six Equal Annual Installments to commence Two years after they arrive at the age of Twenty one years. & the recipt of their land respectively. Item 11th I will & devise that my siad Executors pay the last Installment to my Said Daughters according to their Priority of age. |I.E.| Melissa first, Elizabeth Second, Nancy third, Susannah fourth, Mary fifth, Sara Jane Sixth. Eliza Last as avail may come into their Possession Item 12th I will & devise that Should my towo Sons John & Jacob have paid the Whole amount that may meating to pay my said Daughters before my son William Hanger arrives at tha age of twenty one years according to the intent & meaning of this Will my youngest Sons David & William Hanger come in Possession of their Share of the Property in Consequence of the death of my Wife. I then Require them Jointly to Refund the one third of said deficiency paid by John & Jacob in to Equal annual Installments to commence Two years after William Hanger arrives at the age of twenty one years. Item 13th I do hereby nominate & appoint John Groves & Richard Mood Executors of this y last Will & Testament hereby authorizing & Empowering them to Compromise adjust Release & discharge in Such manner as they deem Proper the debts & claims due me. I do herby revoke all former Wills by me made. In testimony whereof I have hereto Set my hand & Seal this twenty seventh day of January in the year 1848. Signed by David Groves with his seal Signed & acknowledged by said David Groves as his last Will & Testament in our Presence Signed by us in his presence. Thomas McBride & Richard Moode. --- March Term 1849 An motion to the Court Mrs. Mary Grove (widow) of Daniel Grove decd produce to the satisfaction of this court in Writing her signification that she had elected to take under the will of her late husband in lieu of her Dower in his estate. Said will was filed for Probate on the 16th of February 1848. ----- Some receipts in probate packet from the daughters are signed on these dates: October 27, 1848 Elizabeth Wright and Darius Wright June 3, 1851 Malessa (her mark) Bricker and Hiram Bricker September 7. 1857 Eliza Grove attested to by Jacob Tipton April 9, 1850 Mary Plummer attestd to by Jacob Grove October 28, 1848 Nancy Smith and John Smith December 10, 1851 Susannah Stiggers and David Stiggers April 5, 1853 Sarah Jane Grove attested to by James Thomas February 25, 1850 Mary Grove attested to by S.
