The submitter has given permission to the USGenWeb Archives to store the file permanently for free access. http://www.usgwarchives.net *********************************************************************** State of Ohio and Couty of Darke Be it known that on the 28th day of june ad 1854 Before me a judge of the probate court at the county aforesaid Personally appeared Rachel Byers aged 62 years and Samuel Pearce aged 51 years who are each of them residents of the county of dark and state of Ohio and to me well known who being duly caution and then sworn in due form of law deposeth and say that they are two of the natural heirs of Samuel Pearce who was a pensioner in the state of Ohio and his widow whose name was Dorcas Pearce. She being the widow of the identical Samuel Pearce died on the 12th day of June A.D 1828 and their mother Dorcas Pearce who was the widow of the afforesaid pensioner Samuel Pearce died on the 15th day of June A.D. 1842 and that they do not know of any recorded evidence of their paternal father and mothers marriage, and that their afforsaid parents had only four children who came to the age of maturity and that one their names was Enos Pearce who died at his residence in Preble Co., OH in May AD 1845 and that the other named Dianah Fleming, is a resident of the state of Indiana, Tippecanoe Co. whose age is between 53 and 55 years and from the account of their parents report the afforesaid Samuel and Dorcas Pearce they must have been married before the year AD 1792 Rachel Byers Samuel Pierce Witness John Morrison Sworn to the day and year above written and subscribers and I certify that i believe the above named Rachel Byers and Samuel Pearce and Dianah Fleming to be the children and heirs of said pensioner Samuel Pearce and that they are the only living children of said pensioner and that I am disinterested in case. John Whaney Probate Judge At the same time personally appeared before me a judge of said probate court two credible witness named William Martin Sen and Aaron Fleming. Residents of the afforesaid county and state who having been by cautioned and then sworn according to the law do depose and say each of them for his self that he has always heard it said and that is generally believed by the community that Rachel Byers and Samel Pearce of the county of Darke and state of Ohio and Dianah Fleming of the state of Indiana are the sons and daughters of Samuel Pearce the pensioner in the state of Ohio and Dorcas Pearce his widow and that they nearly xxxxx the afforesaid Samuel and Dorcas Pearce to have been married and to have been man and wife that they were acquaintance with them for many years and that they never heard their marriage called in question and that they found there xxxxx of from various reasons one among others that the said pensioner divided his lands and goods among his above named children and at his decease recognized them as his children and said pensioner Samuel Pearce died on the 12th day of June AD 1828 and his widow Dorcas Pearce died 15th day of June 1842.
