Will of Nicholas Reifert June 3, 1851

In the name of God, amen, I Nicholas Reifert, of the township of Vermilion in the
county of Erie, and 
state of Ohio, being of sound mind and memory, do make and publish this my last will
and testament.

I give and bequeath to my beloved son John all the land now belonging to me,
reserving of the proceeds 
of said land a good and comfortable living for my dear wife Ann Martha, during her
natural life.

Also after payment now due on said land shall be paid, I desire my beloved son John
to pay one hundred 
dollars in current money to my dear daugther Catharine Will.

In testimony whereof I hereunto set my hand and seal, and publish and decree this to
be my last will and 
testament in presence of the witness names below, this third day of June in the year
of our lord one 
thousand eight hundred and fifty one.

Signed, sealed, declares and published by said Nicholas Reifert, as and for his last
will and testament, in 
the presence of us, who, at his request, and in his presence of each other, have
subscribed our names as 
witnesses hereto

In the name of God Amen.  I Nicholas Reifert being of sound mind do make and publish
this a codicil to 
my last will and testament within written, that it is my intention that my son
John’s inheritance of the 
lands within described shall be on the consideration and condition of his making the
provision for his 
mother, and the payment of the one hundred dollars to Catherine Will.

In testimony whereof I have set my hand and seal at Vermilion Erie County Ohio in
the presence of 
witnesses hereunto subscribe this  eighth day of October in the year of our lord one
thousand eight 
hundred and fifty six.

Signed, sealed, declares and publishes as a codicil to this last will and testament
of Nicholas Reifert of 
the town of Vermilion Erie County at his request and in his presence and describe
our names thereto as 
witnesses.

In the matter of the last will and testament.
                      of Nicholas Reifert                     Probate of Will
                              					November 18,1861
								This day came
John Reifert, and produces what purportes to be the last will and testament of
Nicholas Reifert, late of 
Vermilion, deceased, and offered the same for probate thereupon appeared Chauncey C.
Bill one of the 
subscribing witnesses, who, first being duly sworn and examined in open court,
testifies to the due 
execution and at testation of said will and also appears William F. Myers and David
Washington, who, 
after having been duly sworn and examined in open court, testifies to the
genuineness of the signature 
of F. F. Smith, the other subscribing witness, who is now dead, which testimony was
reduced and filed 
with the judge of said court, and appearing to the satisfaction of this court, that
the will was duly 
executed and attested, and that the testator, at the time of its execution, was of
full age, of sound mind 
and memory, and not under any restraint, it is ordered that said will will be
admitted to probate, and 
that it be filed in this office and recorded, together with the testimony.

Additional Comments:
This is a copy of a will from my family archives.  As you can see, the will was
probated in 1861.  Nicholas 
Reifert is buried in the old Cudderback (Orchard Beach) cemetery  with a standing
tombstone Vermilion, 
Erie, Ohio
