On the 31st day of December AD1842. Being Present David Ewing, Joseph Stukey & John Graybill Esqr’e associate Judge of said Court. The following paper writing purporting to be the last will and the testament of Aquilla Greer dec’d was produced in Court and offered to probate to wit: In the name of God, Amen, I Aquilla Greer of the Township of Amanda, in the county of Fairfield and State of Ohio do make and publish this my last will and testament in manner and form following, that is to say. First. It is my will that my funeral expenses and all might just debts be paid. Second I give and bequeath to my beloved wife Lucinda Greer, in lieu of her dower, the farming plantation on which we now live, situate in Amanda township, Fairfield County, Ohio, containing about sixty acres, and all of my stock such as horses, cattle, sheep, hogs, with the increase, grain of every description, all of my farming utensils implements & household furniture by me owned at the time of my death, and all other articles that herein mentioned or specified of every kind, name or nature, so long as she remains my widow and if she, the said Lucinda, marries, then she is to take one third my estate, both real and personal, as the law directs in such cases. Third I give and bequeath to my son Aquilla Greer, now in infant the aforesaid farm on which I now reside, after, the incumbrance of his said that Mother is removed, situate in said Amanda Township, Fairfield County, Ohio, for his sole use and benefit forever- Also all my personal property enumerated as aforesaid, with the increase, after the incumbrance of his said Mother is removed, Also all monies due, to become due, or owing unto me (except the following bequests to his said Aquilla Greer’s half brothers and sisters) or which I may have on hand at the time of my death, with the interest that have or may accrue thereon for his my said son Aquilla Greer’s sole use and benefit forever. But I wish it understood that this bequest shall not interfere with any rights my said wife Lucinda may have in relation to the same. Third. (sic)- I give and devise to my eldest son James Greer, in addition to what he has already received the sum of one dollar. Fourth- I give and bequeath to my second son William Greer, in addition to what I have already given him, the sum of one dollar. Fifth- I give and bequeath to my eldest daughter Harriet Neiman or Newman, in addition to what I had already given her, the sum of one dollar. Sixth- I give and bequeath to my second daughter Mahala Stewart, in addition to what I have already given her, the sum of one dollar. Seventh. I give and devise to my third daughter, Betsey or Elizabeth Blue, in addition to what I have already given her, the sum of one dollar. Eighth- And I give and bequeath to my fourth daughter Mary Peters, in addition to what I have already given her, the sum of one dollar. Sixth (sic)- If my said wife Lucinda should bear me more children than the aforesaid Aquilla, then it is my will that the said bequest made as aforesaid to my said son Aquilla, be divided between my sent son Aquilla and such other child or children as may be born to me by my said wife share and share alike, but if no further increase in my family takes place by my said wife Lucinda, then the aforesaid bequest to said son Aquilla shall stand good as stated. I further desire that my executor shall put such money as shall fall to the share of said son Aquilla out upon interest as speedily as possible, and two of the safest security. I also desire that he shall receive what may be termed a good education. And lastly, I hereby constitute and appoint my said wife Lucinda Greer, and Thomas Prosseck to be the executors for this my last will and testament, revoking and annulling all former wills by me made and ratifying and confirming this and no other to be my last will and testament. In testimony whereof I have hereunto set my hand and seal this 30th day of August AD1836. Signed sealed published and declared by the above named Aquilla Greer, as and for his last will and testament, in the presence of us who at his request, have signed as witnesses to the same. Geo. Sanderson Henry Amoto The State of Ohio Fairfield County In the matter of the probate of the last will and testament of Aquilla Greer late of this county dec’d. Presented to the Court of Common Pleas on the 31st day of December AD1842, And thereupon George Sanderson and Henry Amoto the two subscribing witnesses to said will being duly sworn in open court depose and say that at the time said will was executed the testator Aquilla Greer, was of sound and disposing mind and memory, of full page and not under any restraint, and that they were called upon by said testator two subscribe their names as witnesses to the said will being the same produced here in court for probate.
