G. Scrimger This indenture made this 3rd day of December 1836 between John Goldein and Lucilla his wife of the county of Franklin in the State of Ohio of the one part and William G. Scrimger of the county aforesaid and State aforesaid of the other part Witnesseth that the said John Goldein and Lucilla his wife for and in consideration of the sum of one hundred and eighty dollars to them in hand paid by the said William G. Scrimger, the receipt thereof is hereby acknowledged, hath granted bargained and sold and by these presents doth grant bargain sell alien and confirm unto the said William G. Scrimger and to his heirs and assigns forever all that tract or parcel of land situate in the county of Franklin in the State aforesaid, Bounded and described as follows, to wit, Beginning at a beech tree at the southwest corner of the patent line and running E. over one hundred and ten poles and 5/10 on a rear line between David Thomas and Cutler's land, thence N. ninety three poles 4/10 to a white! oak SE. corner of said Frazells tract, thence South 83 W one hundred and twelve poles to a stake, hickory, ash and buck beach thence South ninety one poles to the place of beginning, containing sixty acres be the same more or less being a part of Military Warrant No. 679. To have and to hold the premises aforesaid with all the privileges and appurtenances therunto belonging or in anywise appertaining unto him the said William G. Scrimger and his heirs and assigns forever. Provided always that these presents are upon this express condition, that if the said John Goldein and Lucilla his wife their exors and administrators shall pay or cause to be paid to the said William G. Scrimger his certain attorney or attorneys heirs exors and administrators or assigns the sum of one hundred and eighty dollars on or before the 3rd day of December 1837 together with the interest that may accrue there on in manner particularly specified in a certain note or obligation bearing _____ date here! with executed by the said John Goldein to the said William G. Scrimger that then and from thenceforth these presents and everything herein contained shall cease and be void, anything herein contained to the contrary notwithstanding. In Witness we have herein to set our hands and seals the day and year above written. John Gouldin § Signed and sealed and Lucilla Gouldin S delivered in the presence § of Miskell Saunders § William Flinn § State of Ohio Franklin County §§ On the 3rd day of December 1836 before the subscriber a Justice of the within and for said county personally the said John Gouldein & Lucilla his wife who signed and sealed the foregoing deed and acknowledged the signing and sealing thereof to be their act and deed for the purposes therein expressed, and the said Lucilla wife of the said John Goldein being and examined separate and apart from her said husband and the contents of said deed made known to her by reading the same in her presence she did declare upon such separate examination that she did voluntarily sign seal and acknowledge same and that she is still satisfied therein. And I do further certify that from my own personal knowledge I am satisfied that the said John Gouldin and Jane *** his wife are the persons they represent themselves to be. Miskell Saunders Justice of the peace. *** The name of Jane is obviously a mistake due to the fact that the transaction on page 50 concerns the same property and was with Warren and Jane Frazell. The Justice must have gotten confused.
