Be it remembered that at a court of Common Pleas within and for the said county of Gallia, held at the court house in the town of Gallipolis on the twelvth day of May in the year of our Lord one thousand eight hundred and forty Eight before the Honorable William V. Peck. Resident Judge Joseph W. Ross, David G. Whiton and Moses R. Mathews associate Judges. This day the last will and Testament of Edward Cottrell Decd. was brought before the Court and proved by the oaths of Phineas B. Gillingham the two subscribing witnesses thereto whose examinations were reduced to writing and it appearing to the satisfaction of the Court that the said Edward Cottrell at the time of executing said will was of full age and of Sound mind & memory & not under any restraint. It is ordered that said will & the proof so reduced to writing be recorded.___ Clay Township 2nd February A.D. 1848 In the name of God amen ___ I Edward Cottrell of the County of Gallia in the State of Ohio being feble in body but of Sound mind and memory do hereby make publish & declare this my last will & Testimony as follows. viz__ 1st & principally I commit my Soul to God and my body to the earth to be decently buried at the discretion of my surviving friends, 2nd my debts which are but few to be punctually paid & 3rd after the payments of said just debts and funeral expenses I hereby give & bequeath to my beloved Rhoda Cottrell for and during her natural lifetime all and Singular my real and personal Estate including all and Singular my rights credits monies & effects to be by her & my Son Stephen Cottrell manage as they may see fit for the Support & comfort of my wife and also for the Support & enduration of my minor Children, during the life time of my wife as aforesaid and at her death. I will and devise that all my property that may be left from her necessary Support & Comfort as aforesaid to be equally divided Share & Share alike amongst my children & legal heirs meaning Real & personal Estate and I hereby ordain nominate & appoint my wife Rhoda Cottrell & my Son Stephen Cottrell Executors of this my last will & Testament. In testimony whereof I have hereunto set my hand & seal this Second day of February A.D. 1848. In the presence of Wm. F. Golden, Phinehas B Gillingham whom I have call'd as witnesses Edward Cottrell (him) In the matter of the will of Edward Cottrell Late of Clay Township Gallia County Ohio decd in Gallia Common pleas Phineas Gillingham of Lawful age being duly sworn in open court deposeth and saith that Edward Cottrell Late of Clay township Gallia County Deceased on the fourth of March A.D. 1848 in the presence of this Deponent and William G. Golding Signed and Sealed the will hereunto annexed that at the same time of Signing and Sealing the same he declared the same to be his last will and testament and requested this deponent and William F. Golding to subscribe the same as witnesses in presence of the said testator and Each other that Said Testator at the time was of sound mnd and memory over twenty one years of age and under no restraint. Dunillard The State of Ohio Gallia County ss To James Flack Esq Greeting Know ye that we trusting in your prudence and fidelity have appointed you and by these present do give you full power and authority to Examine and take the deposition pf William F. Gooldin a witness to the last will and testament of Edward Cottrell deceased and therefore we command you that at a certain day and place to be appointed by your cause said witness to come before you and then and there Exhamin him on his corporal oath first taken before you and that you reduce such examinations to writing and return the same togeather with this writ closed up under your seal into our Court of common pleas within and for Said county of Gallia at the present term thereof with all convenient speed. Witness Joseph Dunillard Clerk of our Said Court of Common Pleas at Gallipolis this 8 day of May A.D. 1848 Jos. Dunillard Clk. And afterwards to wit on the nineteenth day of May in the year of our Lord one thousand Eight hundred and forty Eight and before the court last aforesaid. On application of Rhoda Cottrell and Stephen Cottrell Executrix and executor of the last Will and testament of Edward Cottrell late of this county deceased ___ which will, having been proved at the present term of this court. It is ordered that Letters Testamentary be granted to them who thereupon gave bond to the acceptance of the acceptance of the court with Jacob Blazer & Henry Wise their Sureties in the pinnal sum of fifteen hundred Dollars conditioned according to Law. Ordered that George Northup, Samuel Patterson & Wm F. Gooldin who after being duly sworn appraise the personal Estate of said deceased___ This day to wit: May the eighth A.D. 1848 on motion to the court by Mr. Wilson, it is ordered that a commission issue to James Flack Esqr a Justice of the Peace for the Township of Clay in this county to take the deposition of William F. Gooldin a witness to the last will and testament of Edward Cottrell decd and that he make returns of Said deposition the present Term of this Court. And afterwards, to wit: on the fifteenth day of November in the year of our Lord one thousand eight hundred and forty eight. Rhoda Cottrell and Stephen Cottrell Executrix and Executor of the Said deceased filed in the clerks office of the court of common Pleas aforesaid. an Inventory and appraisement of the goods and chattels rights and credits which were of the said deceased and the Same is in the (?wnds?) and figures following to wit: Clay Tp. 14th Nov 1848 We the undersigned appraisers of the Estate of Edward Cottrell Decd after being duly Sworn have made an inventory and appraisement thereof as follows viz. Wm. F. Gooldin, Samuel Patterson, George Northup appraisers, we the undersigned appraisers do make Solemn oath that we will truly honestly & impartially appraise the property & Estate that may Exhibited to us belonging to the Estate of Edward Cottrell Decd & perform the other duties required by law of us in the premises as appraisers & according to the best of our Knowledge & ability. This day personally appeared before the subscriber clerk of the court of Common Pleas of said county, Stephen Cottrell and made oath that the foregoing inventory is (can't read word) - that it contains a true statement of all the personal Estate of the Said Edward Cottrell decd that has come to his knowledge also of all monies back bills or other circulating medium of Said deceased and particularly of all just claims of Said deceased against this affiant or other persons to the best of his knowledge.
