I have a copy of the original will, but it is virtually unreadable, so I am relying on a transcription provided to me by Fran Miller, who sent me a massive amount of documentation on this Bailey line. She can be reached at ceagle52@earthlink.net. Titus' will is dated April 17, 1805. In the name of God, Amen. I, Titus Baley, of Sterling in the county of Windham and state of Connecticut in Newengland being far advanced in years but of perfect understanding as to a disposing mind praise and thanksgiving to Almighty God for it and knowing that it is appointed for all men once to die and not knowing how soon it please God to take me out of the world do make this my last will and testament and first and principal I bequeath my soul to God that gave it and my body to the earth to be decently interred at the discretion of my executors hereafter named and as to what wordly state it hath pleased God to bless me with I dispose of in the following manner and form. (?) I give and bequeath to my beloved wife Mary Bailey one Negroe girl named Dorcas until she is of age, also two feather beds with sufficient furniture for the same also one chest of high drawers and one low chest. (?) Chest drawers and beds and furniture to be equally divided between Esther Brown and Marcy Bailey after my wife's decease. ITEM. I give to my wife Mary Bailey one third part of my farm and one third part of the holdings thereon standing during her natural life. (?) disposed of by my executors hereafter named as they think proper for her support to the best advantage and after her decease to be equally divided between Eli Bailey, Jared Bailey, Samuel Bailey, Caleb Bailey, and Ethan Allen Bailey. ITEM. I do give and bequeath to my sons Eli Bailey, Jared Bailey, Samuel Bailey, Caleb Bailey and Ethan Allen Bailey, all the lands that shall be possessed of at my decease together with my farming tools, blacksmith tools, and right in the meeting house and my right in the Libra of Voluntown and also my wearing apparel to be equally divided between my above named sons, Eli Bailey, Jared Bailey, Samuel Bailey, Caleb Bailey, and Ethan Allen Bailey. ITEM. I have given to my son James Bailey, the one half of my farm that I now live on together with four hundred and twenty eight dollars in (?) which is in full (?) proportion of my estate which land and money he the (said) James Bailey hath already received from my hand in full. ITEM. I do give and bequeath to my two daughters Esther Brown and Marcy Bailey all my personal estate not otherwise disposed of viz: (?) moveables, housegood estate and furniture that I shall be possessed of at my death which I have not already disposed of also the (?) negro winch named Susannah who is a slave for life all which is to be equally divided between my two said daughters also that they give the said Susannah a good maintenance out of what they receive of my estate during her life. ITEM. I do give and bequeath all the money and obligations I shall be possessed of at my death after my funeral charges and just debts are paid out of it to be equally divided between Eli Bailey, Jared Bailey, Samuel Bailey, Caleb Bailey, Ethan Allen Bailey. ITEM. I do give and bequeath to my wife Mary Bailey, one horse also two cows and ten sheep and after her death to be equally divided between Esther Brown and Marcy Bailey. Further it is the desire and will of our honoured parents that they have a deasant burial with tombstones and their names and ages engraved thereon by my executors who shall be hereafter named. And to see this my will performed and in confirmation and manifestation I Titus Bailey have hereunto set my hand and seal this seventeenth day of April in the year of our Lord one thousand eight hundred and five. I do hereby revoking and making void all other wills and testaments by me heretofore made pronouncing and declaring this and (?) to be my last will and testament signed, sealed: s/s Titus Bailey Signed, sealed and published and pronounced by his hand Titus Bailey as his last will and testament who in his presence and the presence of each other have hereunto subscribed our names. s/s John Wylie, Arch Gordon, Moses Wylie Mary's will is dated June 19, 1806 In the name of God amen. I Mary Bailey of Sterling in the County of Windham being of sound and disposing mind memory and understanding through the mercy of God do make and ordain this my last Will and testament in manner and form following. First and principally I resign my soul with the utmost humility into the hand of Almighty God my Creator humbly hoping for a blessd Immortality through the merits and mediation of my beloved Saviour and redeemer Jesus Christ. and my body I desire may be decently buried at the discretion of my Executor and as for Such temporal Estate as the Lord in his great goodness and mercy hath instrusted me to be the Steward of I give devise and dispose thereof as follows. It is my will that all my Just debts and Charges be paid out of the monies or Debts due to me. I give and bequeath to my two daughters, Esther Brown and Marcy Bailey all my wearing apparel and all my household goods to be Equally divided between them. I give and bequeath to my Daughter Esther Brown and my grand Son Sylvanus Stone, Son of my Daughter Marcy Bailey, all the Stock that I shall be possessed of at my decease to be Equally divided between them also I give to the said Esther Brown and Sylvanus Stone Each of them twenty dollars. I Give and bequeath to my five Sons, Eli Bailey, Jared Bailey, Samuel Bailey, Caleb Bailey and Ethan Allen Bailey, all the monies Debts and any other property I may be possessed of at my Decease not otherwise disposed of in this will to be Equally divided between them. Furthermore it is my will that if the average shares of my forementioned five sons does not (illegible) Each then there shall be a deduction from the twenty Dollars given to Esther Brown and from the twenty dollars given to Sylvanus Stone in proportion to Said Sons and to what my Sons Shares fall Short of thirty five dollars. Lastly I do make and Constitute Anthony Brown my Son in law Executor of this my last will and testament in witness whereof I have hereunto set my hand and Seal this Nineteenth day of June AD 1806. I Do hereby Constitute and appoint Archibald Gordon of said Sterling to be Executor of my said last Will and Testament Jointly with Anthony Brown mentioned as my Executor in said Will and I do hereby Publish and Declare the foregoing Will with this Addition to be my last Will and Testament in witness whereof I have hereunto set my hand and seal this third day of January AD 1818.
