Written: February 14, 1870 Recorded: May 3, 1870 Guernsey County, Ohio Wills, 1852-1875, Volume 2, page 268. Thomas P. Wilson’s Will I Thomas P. Wilson of Guernsey Co., Ohio, desiring to dispose of my earthly effects before my decease, and being of sound mind and memory, do this day make and publish this my Last will and Testament in the manner following. 1. It is my will that all my just debts and funeral expenses should be paid by my Executors and that so much of my personal property as may be necessary after the credits due me are collected, shall be sold for this purpose. 2. I will and bequeath to my wife Martha Wilson and to my son Samuel the use of the 120 acres of land on which I live for the term of five years or until my daughter Rebecca shall be 18 years of age – This bequest being made upon these conditions that the proceeds of the farm are to be used for the purpose of affording a reasonable and comfortable maintenance to all the members of my family remaining at home and that if money beyond what is necessary for this purpose shall be acquired it shall belong to my son Samuel as a compensation for his labor. 3. It is my will that at the end of the five years named above my son Samuel shall have the privilege of assuming full and entire control of the land above named as his own property in fee simple, or if he so elects the farm may then be sold and in either case the following legacies shall then become due. Viz: Fifteen Hundred Dollars to my beloved wife Martha, she to have the use of this amount during her natural life. Two Hundred dollars to my son Samuel as compensation for the service he has already rendered since he was of age and the remainder of the price of the land shall be equally divided between my children, my son Samuel included. In case my son Samuel shall elect to take the farm as his own, the price of it shall be fixed by three disinterested men duly qualified for that purpose and the above named legacies shall then be paid by him. And in case he shall elect to sell the farm then they shall be paid by the Executors hereinafter named. On the death of my wife her share named above shall be equally divided among all my children . 4. At the end of the five years named above the live stock, grain, and farming implements on hand shall belong to my son Samuel and the household furniture kitchen utensils cupboard ware, beds and bedding shall belong to my wife Martha to be disposed by her as she may desire. 5. I hereby nominate and appoint my beloved wife Martha and my son Samuel as the Executors of this my Last Will and Testament, and I bequeath to them in trust the real estate above mentioned, and hereby authorize and empower them at or after the five years named above, to sell and convey in fee simple the aforesaid land without order of court, either at public or private sale in Testimony where I have hereunto set my hand and seal this 14th day of Feb. 1870 Thomas P.
