Thereupon on the 15th day of January A. D. 1917, Charles Schmidt and Frederick Closs, the subscribing witnesses of the last Will and Testament of John Meckler; late of this County, deceased, appeared in open Court, and were duly sworn and examined, according to law, touching the due execution of said Will and their testimony therein was reduced to writing and filed in manner and form following, to-wit;- THE STATE OF OHIO ± HAMILTON COUNTY ± ± HAMILTON PROBATE COURT. Probate of the last Will of John Meckler deceased, presented on the 11th day of January A. D. 1917. Personally appeared in open Court Charles Schmidt and Frederick Closs the subscribing witnesses of the last Will and Testament of John Meckler deceased, who being duly sworn, according to law, to speak the truth, the whole truth and nothing but the truth, in relation to the execution of said Will, depose and say, that they were present at the making of said Will, and , at the request of the deceased, subscribed their names to said Will as witnesses in the presence of the deceased and of each other; that they saw the said John Meckler deceased, sign said Will; and heard him acknowledge the same to be his last Will and Testament; that the said Jon Meckler was, at the time of making and signing said Will, of legal age and of sound and disposing mind and memory, and under no undue or unlawful restraint whatsoever. *Charles Schmidt (*note; Brother-in-law of John Meckler) Frederick Closs, Sworn to and subscribed in open Court, this 15th day of January A. D. 1917. Wm. H. Lueders, Probate Judge. And thereupon on the 15th day of January A. D. 1917, our said Court made an order herein as follows, to-wit;- P R O B A T E & C. In Re Last Will and Testament of John Meckler deceased. The last Will and Testament of John Meckler deceased, late of this county, was on the 11th day of January 1917, presented to the Court for probate and record. And it appearing to the Court that decedent died leaving no widow and that all the next of kin of said decedent resident of Ohio, have waived notice and consent to the probate of said Will. Thereupon, on the 15th day of January A. D. 1917 came into open Court Charles Schmidt and Fredrick Closs the subscribing witnesses to said Will and were duly sworn and examined and their testimony was reduced to writing and filed. Ant it appearing to the Court from the testimony so taken, that said Will was duly executed and attested, and that at the time of executing same the testator was of legal age, sound mind and memory, and not under any restraint, the Court now admits the said Will of John Meckler deceased, to probate and orders the same, together with the testimony so taken, to be recorded according to law. On application, made as provided by Statute, the court grants unto Mary (Meckler) Grauel letters testamentary undersaid Will, she being named executrix therein. Whereupon the said Mary (Meckler) Grauel in open Court accepted said appointment and filed an estimate of the whole estate, together with a statement that she is not indebted to the decedent. Bond waived by Will. Publication of the above named appointment is hereby ordered made in the Times Star a newspaper of general circulation in this Country. Letters issued. Wm. H. Please at the Court House, in Cincinnati, in the County of Hamilton and State of Ohio, of the Hamilton, Probate Court, at a session thereof , held at the place aforesaid, on the 15th day of January A. D. 1917, before the Hon. William H. Lueders, sole Judge of said Court. THE STATE OF OHIO ± ± S. S. HAMILTON COUNTY ± HAMILTON PROBATE COURT. Be it remembered, that on the 11th day of January A. D. 1917, the last Will and Testament of John Meckler, late of the county, deceased, was presented to this court for probate and record, clothed in the words and figures following, to-wit;- W I L L . Know all men by these Presents: That I John Meckler of the City of Cincinnati, Ohio do hereby make and execute this my last will and testament and I do ordain; First - I direct that my debts be paid. Second - I give and bequest unto my daughter Julia Lyons (nee Meckler) the sum of Fifty ($50.00) Dollars. Third - I give, device, will and bequeath unto my daughter Mary Grauel (nee Meckler) all of the residue and remainder of my property and estate of every kind, nature and description, and wheresoever's situated, to have and to hold to her own use and to her heirs and assigns forever - My reason for giving my said daughter Mary the most of my estate is that she has taken care of and lived with me and I desire to compensate and reward her for the many services she performs and kindnesses to me - Fourth: I nominate and appoint my said daughter Mary Grauel as the executrix of my estate and will and respectfully request that the Probate Court do not require her to give any bond as such executrix.
