Record of the Will of James Tarbert Deceased.

In the name of my heaven Father I James Tarbert of Nothingham Township, 
Harrison Co, Ohio do make and publish this my last will and Testament.
 
1. I give and devise unto my son James Tarbert Five hundred dollars as a set 
off for labor, he performed after he was of age.  Also to my Grandson James 
Madison Wilson if he lives to the age of twenty one, three hundred dollars 
and if not living at that age said three hundred dollars to fall back into 
the hands of my heirs.

2. I give and devise the remainder of my estate unto my sons, Peter Tarbert, 
William Tarbert, John Tarbert, James Tarbert, Josiah Tarbert each the one 
seventh part of the proceeds of my real and personal property. Also the one 
seventh part of the proceeds of the same to equally divide among the 
children of my son Robert Tarbert deceased.   Also the one seventh part of 
the proceeds of said to be equally divided among the Children of Joseph 
Anderson Tarbert deceased all of which is to be disposed of as hereafter 
described.

3. I devise my real and personal property to be sold as follows and the 
proceeds divided as before specified after the payment of my just debts and 
funeral expenses.  Namely the quarter section of land on which I reside. I 
value at three thousand dollars and the children of my son Joseph Anderson 
Tarbert deceased shall have the privilege of taking fifty acres in the South 
West corner of said quarter at my valuation and account for the same. And my 
son James Tarbert shall have the privilege of taking the remainder of said 
quarter (being one hundred and ten acres) at my valuation and accounting for 
the same. Also the sixty acre tract adjoining lands with my son William and 
being a part of the same quarter and my son William Tarbert shall have the 
privilege of taking said tract at my valuation and the proceeds of all of 
said lands and  the proceed of all of said lands shall be divided according 
to the order first specified.  If, however, said heirs of Joseph A. Tarbert 
and said James & William Tarbert do not choose to take said tracts of land 
at the above valuation and account for the same I desire that both tracts of 
land be sold at public sale. 

4. I do hereby appoint and nominate my son William executor of this my last 
Will and Testament, hereby authorizing and empowering him to adjust release 
and discharge in such manner as he may  deem proper the debts and claims due 
me. I do also authorizes & empower him to make deeds to purchasers 
acknowledge & deliver the same in fee simple. In testimony whereof I 
hereunto set my hand and seal this 20 day of February A.D. 1861.

will & Testimony in the presence and signed by us in his presence
