I desire to be decently buried in the church yard at Burgess Chappel also I give and bequeath unto my sone Henson all my goods and chattels moneys and accounts whatsoever and I do hereby constitute and appoint my sone Henson Sole executrix [sic] of this my last will and testament in witness whereof I have set my hand and my seal the day and year first above written his Richard X Burgess seal mark [signature] John Kennedy [signature] Joshua Wilson Additional Comments: Photocopy of handwritten will that was made known to the probate court on 8 April 1872. I have no information about the will being recorded before that date. Even though enumerators for 1860 and 1870 cenususes recorded individuals that could not write on the same page as Richard's listing, they did not indicat that Richard could not write. The fact that the will was not recorded prior to his death and the probability that Richard could at least sign his name, and theat the executor was the sole heir to the exclusion of several of the executor's siblings calls into question the validity of this will, even though it was accepted by the probate court.
