Which is in the words and figures following to wit. In the name of God, Amen. I, Robert Elder, of Clinton Township, in the County of Jackson and State of Ohio, considering the uncertainity of this mortal life and being of sound and perfect mind and memory. Blessed be the mighty God for the same. I do make, Ordain and publish this, my last Well and Testament in manner and form following, that is to say, first I give and bequeath unto my beloved wife, Mary Elder, all my personal property whatever name or nature at her own disposal and use and the improvements of all my real estate for and during her natural life after my beloved wife's decease then all my personal and real estate to be divided equally between my beloved children. Namely, Anna Shreck, wife of Garrett Schreck. Thomas Elder, Isabel Exline, Wife of Daniel Exline, Mary Anthony, wife of Nicholas Anthony, Elizabeth Westfall, wife of Eli Westfall, James Phillips, wife of Robert Philliips, Robert Elder, Lydia Stephens, wife of Benjamin Stephens, Margaret Anderson, wife of James Anderson, Nancy A Elder, Corneilius G. Elder and Sarah Elder. I wish all of my debts to be paid. I give and devise to my beloved daughter, Elizabeth Westfall, wife of Eli Westfall, one tract or parcel of land lying and being in Jackson County and State of Ohio being the west half of the south east quarter of sectional is in township Nine and Range seventeen containing eighty acres be the same more or less. It is my will that they should have a deed after my decease without any of the rest of their heirs sharing any part of this land. This my last will and testament utterly disannulling and revoking all former wills by me made, in testimony whereof I have here unto set my hand and seal this thirteenth day of September in the year of our Lord one thousand eight hundred and thirty five. Sighend, sealed, published and delivered by the above named Robert Elder to be his last will and testament, in the presence of us who at his request and in his presents subscribed our names as witnesses. Robert Elder, Patrick Shearer, James Dempsey. State of Ohio, Jackson County, at a Court holden in and for said County at the Court House in the Town of Jackson, this eighteenth day of April A.D. 1836, the above and foregoing instrument was produced in open Court as the last will and testament of Robert Elder, late of said County, deceased, and therupon Patric Shearer and James Dempsey, the subscribing witnesses thereto were also produced in open court and being then and there duly sworn to give testimony respecting the execution of said will, and true and distinct answers to such question as shall be put to them respecting the same, did upon their oath aforesaid, depose, declare and say that they were present at the date thereof and saw the said Robert Elder sign and execute said will, that he then and there declared the same to be his last will and testament, the same having been read and fully explained and made known to him, that at the time of the execution thereof he was of sound and disposing mind and memory and full age, and not under any restraint and desired the said deponants to subscribe their names thereto as the witnesses to his last will and testament which they then and there did in his presence and at his request, which said proof is hereby reduced to writing and the clerk of said court is ordered to record said will together with the above proof agreeably to the nature in such case made and provided attest Daniel Hoffman, Clerk of Jackson County. Additional Comments: Robert Elder was born in Pennsylvania in 1769 and came to Jackson County, Ohio about 1810 with James Dempsey, his legal ward. He was married to Mary A. Dempsey, a sister to James and Jonathan Dempsey.
