M., Oct 8, 1906 Recorded, October 23, 1906, In Deed Book 93, Pages 12, 13 & 14. Chas Myers County Recorder Know all men by these presents: That James B. Lowry and his wife, Cora Lowry, and John T. Lowry In consideration of Three Thousand Three Hundred Thirty Three Dollars and Thirty Four Cents to us paid by William A. Lowry The receipt whereof is hereby acknowledged, do hereby Grant, Bargain, Sell and Convey to the said William A. Lowry His heirs, and assigns forever, the undivided two thirds in and to the following real estate, situated in Ross Township, in the County of Jefferson and State of Ohio, and described as follows: Tract Number 1. Situated in Township Number Eleven (11) Range Three (3) Section Five (5) and being the same tract of land conveyed by James Lowry and wife to Alexander Lowry by deed dated April 5, 1861, and recorded in deed book M. Page 369, and described as follows: in said deed last named: Bounded on the North by lands belonging to Daniel Grafton, E. by John Billman W. by Saultsman and Lowry and S. by said Lowry containing 81 acres, the same being more or less. Tract Number 2. Being part of Section 5, Township 11, Range 3, bounded and described as follows: Beginning the first piece at the NW. Corner of the E. half of the SW. quarter of the aforesaid section at a stone, from which a hickory 8” in diameter bears S. 60 ˝ deg. W. 43 links, and a hemlock stump 22” in diameter bears N. 28 ˝ deg. E. 5 links. The same being corner to land of David Call and William Saultsman, set by Anthony Middlesworth, County Surveyor, of said County. Dated June, 1847, Book B. Page 244, by request of John Saults- man; Thence E. with the division line of said section 160 P. to the NE. corner of the W. half of the SE. quarter of said section, from which a white oak 20” P ; thence S. with division line of said quarter 25 P to a post in said line; thence W. parallel with the division line of said sec. 160 Rods to the division line of the SW. quarter of said sec- tion to a post in said line, from which a dogwood bears N. 53 deg. W. 6 ˝ links, and a sassafras 1 ˝ in. DB. N. 6 ˝ links; thence N. 25 rods to the place of beginning, containing 25 acres be the same more or less. Also, the SE. quarter of the NW. quarter containing 40 acres more or less, excepting therefrom the Pine Grove Church lot containing 1 acre and 5 rods, situate in the NE. part of said quarter beginning 2 rods W. of the NE. corner of quarter; thence W. 18 P thence S. 10. P; thence E. 13 P.; thence N. 3 P; thence E. 5 P; thence N. 7 P. to the beginning containing 1 acre and 5 rods. Tract # 3. Being the NE. quarter of section 5, Township 11, Range 3, and bounded on the N. by Brush Creek Township, and on the E. by Saline Tp. Said described premises and part of land once owned by John Billman, containing 20 acres more or less. Tract Number 4. Being a part of the NE. quarter of Section 5 Tp. 11 and Range 3 and bounded as follows: On the W. by lands of James Lowry, on the N. by land owned by John Billman, on the E. by lands formerly owned by Martin Saultsman, and on the S. by the lands of Peter Vandyke, containing 63 acres be the same more or less. Said four tracts of land are adjoining each other and to- gether form one body of land upon which Alexander Lowry resided at the time of his death and which by his last will and testament he devised the same to said James B. Lowry, John T. Lowry and William Lowry and said land contains in all 228 Acres less 5 rods. The said grantors reserve their two thirds undivided in- terest in the coal underlying said land, and they also reserve their two thirds undivided interest in the oil and gas in said lands for a period of 40 years, with right to drill for and produce the same for said period, but said first parties, heirs and assigns to be liable for all damage done by drilling for oil or gas. and all the Estate, Title and Interest of the said James B. Lowry and his wife Cora Lowry and John T. Lowry either in Law or Equity, in and to the said premises; Together with all the privileges and appurtenances to the same belonging: To have and to hold the same to the only proper use of the said William A. Lowry His heirs, and assigns forever. And the said James B. Lowry and his wife Cora Lowry and John T. Lowry For themselves and their heirs, executors and administrators, hereby Covenant with the said William A. Lowry his heirs, and assigns, that they are the true and lawful owners of the said premises, and have full power to convey the same; and that the title so conveyed is Clear, Free and Unencumbered; And further, That they will Warrant and Defend the same against all claims of all persons whomsoever; In Witness Whereof, The said James B. Lowry and his wife Cora Lowry, and John T. Lowry, the said Cora Lowry hereby releasing all her right and expectancy of Dower in the said premises, have hereunto set their hands this 5th day of October in the year of our Lord one thousand nine hundred and six.
