November 1825 paid plaintiff in full at his store in Knoxville, by the hand of William Lowry in the above case of Hunter vs Willoughby. *** page 7*** 1825 James Clear Plea upon the case vs This suit is brought for ballance of book amount John Willaby Debt $5.31 1/4 cents August 16th Summons on said day issued to the constable returnable on Tuesday the 23rd of this instant at two oclock on said day. Constable returned summons according the command by copy. Partys did not appear. Plantiff appeared in the evening. Justice cost 12 1/2 cents Constables fees, mileage 10 cents copy 12 1/2 cents= 22 1/2 cents This suit is continued. Continuance 10 cents. Till Willabys return to his home and it appearing that he was at home on the 10-11 of September following. September the 13th. This day came the planitff and requested that judgment might be given against the deffendent and after being sworn to his account of do, I judge that the said James Cleare have judgment against the deffendent for the above sum and costs of suit. Justice cost of judgment 25 cents. Execution issued the 20th of this instant and put into the constables hand same day. Justice cost of execution 25 cents. Constable returned the execution in the above case on the 4th of October and plantiff recd in full. Constables costs milage 10 cents, collecting fee 0.25 cents. Constable cost fully paid. ***page 8*** 1825 Bengeman Doyle Action on the case vs Debt on account Vallantine Smith Credited this case with one dollar order from James Mitchel in ful on James August 2nd Lawry his recd in full. Copies issued on said day to constable. Defendent appeared without being taken ----and James Mitikel went his bail and pospond the suit til the 13th at this instant at two oclock on said day. Justice cost for copies 12 1/2 cents. Subpoena for Thomas Clinton 12 cents. Partys appeared and on hearing the proofs and allagations of the partys at the time app--- judgment is delayed til Tuesday the 23rd instant at two oclock with the privledge of brining further proof. Partys met on the last mentioned day. This suit is posponed by the consent of partys to the first Tuesday of November next. Clintons fee 50 cents. Posponment 10 cents. Subpoena issued to constable for Thos Clinton and James Lowry. Returnable on said day being November the first. Subpoena returned at the time appointed. Witness attended. Defendent did not appeare. The plaintiff requested the cause to be determined at the time appointed on the oath of Thomas Clinton and James Lowry --- I do adjudge that the plaintiff have judgment for a tour of tending kettle, the time of Saltsmans Swingling frolick ---the defendent and on his own oath, half a tour. Two subpoenas, see page 9. ***page 9*** 1825 James Lowry This suit is brought on a settled account $10.00 vs Bengemin Doyle Ameable suit August 26th At the desire of the plantiff, Justice cost 12 1/2 cents. Deffendent appeared and confessed judgment for the above sum. Deffendent offered the plaintiff a red and white cow for the above sum and he excepted it and ordered the docket to be credit with the above sum. 1825 from page 8 Bengemen Doyle Recd. of by order from Clinton, his ful debt for a tour and an half tinding vs kettels. Valentine Smith Justice bill of costs 75 cents. William Roach October 8th Trial had same day. Defendent claims that the property that is two houses were put in as surity for bailing said Thos. Roach. Partys being present and on hearing the proof and allagations of the partys I do adjudge that claiment hold the said property untill the debt and costs be fully paid for, witch it is alledge and plantiff pay cost, suit costs fully paid. ***page 15*** 1825 Thomas Roach Demand debt and damage. $27.00 vs This suit is brought to try the merits of a bill of earthern ware said to Henry Give have been lost at an arbetrasion between the partys. October 11th copies issued on same day. Constable executed said copies by bringing the body of the defendent forth October the 25th. Partys present this suit by agreement between them is posponed until the last Tuesday in December next. Copies 12 1/2 cents. Constable fee .31 1/2 cents. Continuance 10 cents. December the 20th, Subpoena issued for John Jackman, Esq., Danel Winshal and Katherin Winshal on the part of the planitff and Thos. George, William Pangburn and Bengeman Paul on the part of the defendent. December the 27 party met and proceeded to trial. Witness present Daniel Winshal, Katharin Winshal on the part of the plaintiff and Thomas George, William Pangburn, Bengemin Paul, William Scott, Jesse Malder and Danel Vanhorn and on hearing the testimony of the above said witnesses, judgment is delayed til Tuesday the 10th day of January next at one oclock of said day with the --- of other proof. Judgment 25 cents. *** page 16*** 1825 Mathew Russel This action is brought on a plea of tresspass for the kiling of a dog vs Dammage claim $7.00 Danel Saltsman Subpoena .23 1/2 cents November the 12th Amicable Suit. Partys being present, defendent denied the kiling said dog. In consequence, this suit is posponed til Satterday the 26th of this instant at one oclock of said day. Witness Robert Towney, James Lowry and Joseph Russel, Philip Saltsman and James Lawrane subpoenas issued Nov. 21st. November 26th partys met persuent to agrement and proceded to trial. On hearing the proof ad-ed in this case and being fully satisfyed that the defendent is gilty of kiling said dog, witch from the testimony of James Towny and Joseph Russel, is the property of Mathew Russel, plaintiff in this suit, my judgment is that the defendent pay the plaintiff as a damage for said dog, the sum of $4.50, justice cost 25 cents, costs of suit, constable cost 62 1/2 cents. April 3rd, Constable said paid in full. February the 20th plaintiff acknowledged payment by a receipt from David Call and Robert George in full for wolf scalps claimed of said Mathew Russel for $3.25 (signed) Thos. Eckley ***page 17*** 1825 Thomas Roach This suit is brought to recover pay for service rendered respecting a vs stray claim $1.00 John P. Rook November the 29th cost of summons 12 1/2 cents, subpoena 12 1/2 cents. Summons issued on said day, returnable the 6th of December. On shewing subpoena issued for John Roach satisfied. December the 6th party met and on hearing the proof and allagation of the partys, my judgement is that the defendent pay the plaintiff 50 cents and costs of suit. Constable fees mileage 30 cents, serving 10 cents, justice costs 31 1/2 cents. Defendent paid on same day 50 cents. The plaintiff demand witch was paid over to plaintiff the same day. October the 11th Defendent John Roach in the case of Leatherbery paid $j1.37 1/2 being the ballance in ful to said plaintiff, justices costs being unpaid except a 12 1/2 cents. December the 23, 1826 paid the above sum to Leatherberry being the ballance in full the --- execution issued in the case Leatherberry vs John Roach the 29th of July for $6.67 1/2. Returned September the 5th property not sold for want of bidders. Constable cost 65 cents. September 25th Constable paid on the above case $3.50. Constable cost in full $2.11 1/2 Paid $2.00 to said Constable September the 28th paid plaintiff $1.50 ***page 18*** 1825 A. Leatherberry This suit is brought on due bill payable to H. L. Wooster dated the 2 of June on the order of 1825. H. L. Wooster Debt $5.00 vs Justice cost on interest 12 1/2 cents. John Roach Judgement 12 1/2 cents. December the 6th Bail bond 25 cents Execution 25 cents Issued execution 25 cents 3rd execution 25 cents 4th execution 25 cents Deffendent appeared and confessed for the above sum December 6th with cost of suit. At the suit of A. Leatherberry on the order of H. L. Wooster, A. G. --- to John Roach, Jerrimiah Roach, do acknowledge myself bail for John Roach in the sum of $5.12 1/2 cents and costs and costs that may accrue to be levied on my goods and chattle, lands and tennaments in case said John Roach fails to make payment for witch judgement stands against him in said suit. Aprile the 7th 1826 Thos Eckley returned the above execution property leavied on and not sold for want of bidders, one hooken, one duck oven and one falling axe, one table. Constable cost 60 cents. A second execution issued Aprile 15th to Constable Bunget. May the 11th Constable returned this second execution property not sold for want of bidders the amount May 16th $7.37, including a 62 1/2 cents Bengets cost interest to June tenth. May the 16th a third execution issued. June the 12th Constable returned this writ with two dollars paid thereon. Constable cost on the same 70 cents ballance 67 1/2 cents. July the 25th paid plaintiff the above. July 29th fourth execution issued (see page 17) ***page 19*** Philip Saltsman Jr. This suit is brought on note dated October the 28th 1824 vs due October the 28th 1825. Thomas Clinton, principal Debt $6.39 1/2 cents and Justice cost 12 1/2 cents on judgment George Mushrush Cost of execution 25 cents December the 15th 2, execution issued 25 cents Summons on said day to both partys returnable on Tuesday the 20th of this instant. December the 28th, defendent appeared and confessed judgment for the above sum with cost of suit. January 21st 1826 execution issued. Fabryary the 28th execution returned no property sold for want of bidders which by the consent of the plaintiff is stayed for ten days. Constable sot paid .52 cents. March the 15th 1826, 2 execution issued to constable same day. Aprile the 7th 1826 constable returned the above executions with $6.00 dollars made thereon. Constable cost milage 20 cents, leavy 20 cents, advertising 20 cents. Thos Eckley April the 12th, 1826 paid the plaintiff six dollars of the above suit. ***page 20*** 1825 Philip Saltsman This suit is brought on note dated October the 23th, 1824 due vs October the 28th, 1825. George Mushrush Debt $1.76 and Justice cost 12 1/2 cents Thomas Clinton December the 15th Summons issued on said to both partys, returnable on Tuesday the 20th of this instant. Defendents appeared and paid the debt and cost December 20th, 1825. Paid plantiff in full December the 27th, 1825. ***page 21*** 1825 Philip Saltsman This suit is brought on note dated October the 28th, 1824 due October the vs 28th 1825. Summons issued on said day to both partys, returnable on Tuesday, the 20th of this instant. December the 20th returned summons served by reading to john Roach. Roberts not found. Defendents not appearing posponed until Tuesday the 27th of this instant. Defendent appeared and confessed for the above debt and cost of suit. Defendent produced an order from Thomas Eckley on the plaintiff witch the plaintiff admitted in discharge of said debt. Obidiah Reed Debt $18.25 December the 14th Interest 10 cents Copies issued on Justice cost 12 1/2 cents said day. Judgment 12 1/2 cents Execution 25 cents January the 3rd, 1826, Constable executed the command by bringing the body of the defendent forthwith -- defendent confessed judgment for the above sum and cost of suit. Copies returned on said day. Constable fee 35 cents. Execution issued on the said 3rd day of January, 1826 and given to Constable said day. January the 31st, execution returned property leaved on and provin to be another claiments. Constable fee, milage 25 cents, leavie 20 cents advertising 25 cents. On the case whare Mary Graham vs Obidiah Reed, J. James Maple, do, acknowledge judgment for three dollars and 50 cents too Lowry and Eckley for costs in said suit in case said Reed fails to pay the same. Summons issued on Execution judgement 12 1/2 cents said day to be Issued D-- 25 cents. returned on Tuesday Bail Bond 25 cents, 3-25 the 27th of this instant. In the suit of H. L. Wooster against James Stewart and Thomas George, do acknowledge my self bail for said James Stewart in the final sum of $28.00 dollars to be leaved on any goods and chattels, lands and tennements in case the said Stewart fails to make payment for witch judment is entered against him in said suit. Fabruary the 1st 1826 paid plaintiff his demand in full at his office in Knoxville. September 25, 1826 Constable paid in Cloe Wooster vs Stewart. $16.00. Constab le cost in the case of Wooster vs Stewart from page 23.2.87 1/2 paid in full September 24th. Justice cost in the same $1.37 paid. September 25th Constable returned execution with $11.00 of the principle made thereon. Ballance $4.00 1/2. Note when the above $16.00 was paid in the demand was $2.00--60 see page 24 for a guide. ***page 25*** 1825 H. L. Wister This suit is brought on book accounts vs Amount 81 cents James Stewart Cost on judgment 12 1/2 cents. December the 27th amiable suit Defendent appeared and confessed judgment for the above sum with cost of suit. ---the above amount is included in the 4th execution issued against Stewart. Ballance in the case of Wooster vs Stewart for 90 cents including 30 cents. Cost for Eekley. Paid September 25th $11.20 of principal. The whole demand was $20.90 debt and cost. Paid Burget his cost $2.87 1/2. Paid Justice $1.92 1/2. 54 cents interest included Debt and interest $5.37 1/2 September the 12 day AD 1827 then surefucious issued constable served sire----returned the 18th day Sept. and no cause shewn by defendent the same day execution issued to constable. October the 22 day execution returned. No money made for want -- of bidders. One dollar paid to constable on execution. Give 20 cents, Cons. 40 cents. The 26 day of December Constable paid in three dollars. Execution 25 cents. April the 28th AD 1829 Constable paid two dollars. Cons. for Exec. 76 cents and 53 cents in full of the above judgment. Const. 75 cents. Execution issued the 2nd June with no mony made for want of bidders. Execution issued the 28th May 1833. Constable cost 70 cents. The above execution was paid of by the defendent the 2 day of August 1833 being five dollars and 90 cents in full of what is comeing to Wm. T. Burget on the said execution. September the 8th warrent executed by bringing the defendent forward. The defendent plead guilty of the charge laid against him. Whereon my jugment is that the defendent pay five dollars with costs of suit. William McClain paid 80 cents on the balence of cost above debt May the 9 then received the above jugment in ful by me George Cummings. ***page 112*** William Johnston vs This suit is brought on tresspass on moving fence on the Joseph Shepherd plantif land and thereby ---the road Sumens isued the 4 Damage $90.00 day of Septm, returned Justice fee 25 cents the 9 inst served by reading Constable fee 22 cents The same day parties met and not agreeing, the action was put of until the 17 inst by request of the defendent until he would get the line run by the surveyer. The defendent came the 18 day and not getting the line run betwixt him and Johnston, he requested to have the trial put of until the 25 day of Septm at 2 oclock. The parties met and agreed to leave the trial to men and to settle among themselves the next week. The parties did not agree the week they promised to settle the dispute. Then came the plantif and requested the trial to be pospond until he could get the line run by the surveyor to prove where the line was. The parties met the 9 December and agreed as follows. The said Joseph Shepherd agrees to move his fence in five feet and an half from the line now run. The said Johnnston agrees to make a gate at the end of the lane above his spring next to Shepherd and they both bind themselves to comply with the agreement in the course of two weeks from the 9 of December. The said Shepherd pays all costs. Constable fee paid. The defendent paid thirty five cents on the above costs. The men to be qualified by Juge George or his son, Robert, if the justice could not attend. The same day the parties and arbitraters met at Thomas Georges for trial and the defendent failed in standing the suit. On the 10 day of December, 1831, a citation isued for the defendent to come and bring his witnesses and stand the suit at my house on the 23 instant and abide by my jugment. Citation served by John Roach by reading the 24 day the plantif attended and at the request of the planitf, jugment went against the defendent for two dollar debt and three dollars dammage with costs of suit by default. The parties met and the defendent confessed a jugment for the above debt with costs of suit the 7 day of August 1832. Execution isued the 11 day of August, returned execution stayed by order of the plantif the 11 September execution isued the 22 day Novm 1832 and the Constable levied on a horse supposed to belong to Jacob D and Abram Dennis and said A Dennis notified the plantif to attend the 11 December to see the horse proven and a supena isued for Mathew Roach, John Roach, James Lowry and William Casselman, the same day they all attended and H. L. Woster put of the trial unto the 17 day of Decem 1832 for want of a witness. Subpena isued for Mathew Roach, John Roach, James Lowry and Wm. Carsnes on the same day at 4 oclock to hear and defirmin said complaint the same day the Constable returned said summens duly served thereupon the freeholders appeared and having been duly sworn and enquiring into said complaint the jury returned the following verdict. We the undersined to whom was refered the complaint of John Carson as an insane person and after being duly sworn and having examined and questioned him do believe him to be insane and incapable to transact his own business and aught to have a guardian appointed to transact his business for him and we also believe there is no necessity for having him confined for we believe there is no danger of him destroying his own life or property or the life or property of any person. John Saltsman ***page 230*** Justice record on complaint of an insane person James Mitchel companer of John Carson State of Ohio, Jefferson County, August the 27th day on complaint made to me in writing by the said James Mitchel that one John Carson of Ross township for sum time was struck with the dead palsey and has become insane and not capable of providing for himself or to transact any business. On the 30th instant I isued a warrent for the said John Carson and a sumons for 7 disentrested freeholders unto John Roach, Constable, to being the said Joh Carson and freeholders before me at my office on the 31 instant at 2 oclock on said day. The same day the Constable returned the warrent executed by bringing the said John Carson forthwith. Sumons served and thereupon the jurors attended and having been duly sworn and having examined the said J. Carson, the jury returned the following verdict. We the undersigned freeholders being duly summoned, impaneled and sworn to examine the complaint of John Carson, an insane person, made by James Mitchel, and having examined him personally are of opinion that the said John Carson is insane and that he aught to have a guardian appointed and is not in our opinion capable of transmiting any business whatsoever and we are of oppinion that the said John Carson and family stands in need of immediate relief and we are also of opinion that John Carson does not need to be confined for it is our oppinion that there is not any danger of his destroying his life or property or the life or property of any person.
