All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/oh/ohfiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Danette Schubert dschubert1@hot.rr.com February 16, 2011, 3:10 pm Source: Lake County Will Record B, Pages 195-197 Written: January 28, 1865 LAST WILL AND TESTAMENT OF DANIEL MARBLE OF KIRTLAND, LAKE, OHIO Being conscious of my approaching dissolution and realizing my obligation as a parent and husband, hoping to be guided by impartial justice and in good will to all men and in sympathy and affection with all my family I, Daniel Marble, do make and publish this my last Will and Testament. 1st I give and devise to my beloved wife all the household goods furniture and provisions of every kind of which I may be possessed at the time of my decease. 2nd I give and bequeath to my son Leonard W. Marble and to my daughter Laura Pierce the farm on which I now reside situated in the Township of Kirtland Track 3, Lots 88 and 105 and contains 102 17/100 acres of land being all the land I own, each, one equal half. I also give and devise to the above named children in equal rights all the stock and personal property of every kind (except household goods and provisions as above) which I may own at the time of my decease provided the said Leonard W. Marble and Laura Pierce shall do according to my request herein after specified. It is my request that my said wife Lydia and my unfortunate daughter Clarissa be provided with comfortable food and clothing, with medical aid when necessary, that they receive all the care and attention which their situation and condition may require during their natural lives and that they remain upon the farm if they choose. It is further my request that my son Leonard W. Marble and my daughter Laura Pierce furnish my said wife Lydia and my unfortunate daughter Clarissa with such food, clothing, medical aid, care and attention and that they all live together upon the farm. Now if my said son Leonard W. Marble and Laura Pierce shall furnish my said wife and my said unfortunate daughter Clarissa as specified in my request then it is my will that the said Leonard W. Marble and Laura Pierce shall have my said farm goods and chattels as hereinfore mentioned. But if my son Leonard W. Marble and my daughter Laura Pierce shall disregard my request or shall fail to provide for my said wife and unfortunate daughter Clarissa as specified in my foregoing request, then I hereby authorize my executor to sell the personal property which may belong to my estate, and also the real estate if he may deem the same necessary for the use and support of my said wife and unfortunate daughter Clarissa, and the remainder or residue of my estate, (if there should be any at the decease of my wife and Clarissa) I give and bequeath to my son Leonard W. Marble and Laura Pierce their heirs forever. I think justice requires I should make no provision for my daughter Lucretia Waist and my daughter Eunice. Hitt. I hereby nominate and appoint Alexander Williams executor of this my last Will and Testament. In witness hereof I have hereunto set my hand and seal this the 28th day of January in the year eighteen hundred sixty-five.
